My wife will give birth AFTER our I-140 Consular Interview

I have an approved I-140, current PD and are currently at the NVC stage and should get a case number in a few weeks (Consular Processing, not AOS).

 

My wife is also 3 months pregnant... By the looks of it she will give birth a few weeks *after* our interview at the American Embassy. I've read a lot of stuff online about the baby being derivative or follow to join, but it's confusing. Do I need to file any paperwork? or just take them to the US with us and she will get her GC upon entry?

The child is automatically a USC by virtue of you being the papa. You need to do some research about Certification of Birth Abroad, and/or Consular Report of Birth Abroad.

[01/10, 2018]  - DAY 001  (day 2149) (US Passport) Applied for US Passport, regular processing

01/25, 2018]  - DAY 015  (day 2164) (US Passport) Passport in hand (5 years, 11 months, 3 days from start of Journey.)

[06/14, 2013] - DAY 001 Mailed package to Chicago Lockbox via USPS overnight
[11/21, 2013] - Day 153 SSN and 10-year GC in hand

09/01, 2021]  - (day 3001) (US Passport) Passport in hand (8 years, 2 months, 18 days from start of Journey.)

I'm not a USC, I will be a LPR after my interview at the US Embassy. I currently have an I-140 (work) approved with current priority date and will go through the NVC stage.

Speak to the CO at your interview about it and they will tell you exactly what to do.... baby may need transportation letter (obviously can only get after it’s born).

The short version is Child will be processed on arrival but airlines may refuse to carry without transportation letter. You’ll be at the actual consulate which is best place to answer any questions...
