You broke the rule of this visa (as others have mentioned before).

F2B is specifically for unmarried sons/daughters. You or your petitioner should have redacted the application when you decided to get married.

 

You knew you were breaking the rule but you still stayed in the US for 2 years...not 2 days/weeks/months.

 

No lawyer can fight his case for you. You lied to the US government to obtain a visa....plain and simple.

 

Don't even consider bringing your spouse/kid here. You will all get deported for you breaking the rules.

It's obvious the best course of action for the OP is to IMMEDIATELY self-deport. But I'm curious:

Should the OP file Form I-407 for the green card that he didn't qualify for? Should OP notify embassy* of his willful misrepresentation? Or no action since a misrepresentation bar means that OP chances for legal immigration are extremely low, so this issue is moot?

 

*I did not mention USCIS since I presume OP only minimally interacted with them (they only issued the full 10 year green card after POE based on the embassy's vetting).

I would highly suggest meeting a lawyer asap. you kinda need an aggressive attorney. Look for waiver INA237(a)(1)(H). Its very hard to get and there are certain requirements you to meet in order to get this waiver . this should help you in your situation. what really happened though? why you got married before issuance of your green card? were you not aware of the rules??

I think the problem isn't just the misrepresentation. That's a reason for removal in the first place. But he didn't qualify for the visa or green card in the first place, which is more severe.

this will help in cancelling deportation too.. only problem is that this can only be filled when someone is in deportation already. I think attorney can explain more. I think this not filled with USCIS but at immigration court.

Whether aggressive or kitty cat :bonk:....no attorney can sell this case to any right-thinking immigration judge. The OP knowingly kept the application going for a visa specific to UNMARRIED SON/DAUGHTERS even after getting married. He also stayed in the United States for 2 years after fraudulently obtaining the visa.

there are cases like these before and they were successfully overcame that issue.. kitty cat wont help.. need an experienced attorneys.. this waiver will take care of that.. and yes Attorney can help him out!!

All those suggesting attorneys, waivers etc.. OP knowingly broke the rules. Wasn't even a case of ignorance or not knowing. 

 

Most of us have zero tolerance for those who knowingly lie to get to the US. I prefer this guy be deported and not be in the US, but that's not my call. I somehow feel sympathy for the wife and kid who may suffer back home.

we are not here to judge.. its not our job to deport some one either...  We are here to advice.. I don't know his circumstances so to deport him or not is not my business..

I don't know if he'll get a waiver for this, honestly...even with a good lawyer.

The overstay is one issue---normally a waiver would work----however willful misrepresentation by keeping the visa application going, not being eligible for the green card, and then a 2 year illegal stay on top of that will make things near impossible for him.

Really, can you give us actual links please? The uscis Facebook page keeps publishing stories of how they have been revoking green cards from people who lied to get them in the first place, which is certainly the case for the OP. I’d be very curious to see which of these cases have been “successfully overcome”. Links to as many as you know of, please. (I briefly looked at the type of waiver you posted and can’t see how OP might qualify. )

Since we're on the subject of advice---I have more advice for the OP.  

 

When posting in forums such as these, members tend to look back at posting history to get a more well-rounded sense of the issue at hand/more detailed backstory so that, more often than not, more adequate advice can be given.

 

My thoughts to you, is that it's probably not in your best interests to admit to visa fraud, admit to overstaying illegally, and admit to fraudulently obtaining a GC...while posting your full name, case numbers, and family member full names in various other past threads over the years.  USCIS/COs have been known to peruse these boards.  You may want to ask Mods to remove those.
