Timeline

Just want to share some interesting story. A friend of mine had her CR1 visa interview. Her husband USC lives with them in Germany.

He had no current or continuing income. They had no joint sponsor, no assets. The only thing the USC husband could show is a job offer

for when they move back to the USA. The CO officer approved the application and AOS based on the future job offer.

 

This shows how much power a CO officer has to evaluate the totality of circumstances. In this forum, EVERYONE would tell you,

that without assets, joint sponsor or income the CR1 would be rejected and a future job offer is not enough.

Very interesting. I have a feeling it's still incredibly unlikely for someone to be approved like this so I still don't think I would advise anyone to try that, but I guess you're right, a CO does have a lot of discretion in their toolkit. I'm also curious how they got through the NVC review as well like that. Knowing some more details of this situation here would be awesome.

Does this mean the mother is retired & collects a pension, and is not currently employed?

Actually, something very similar happened to my wife.

As requirement under the visa lottery, this is how she got her green card, she needed 2 years of work experience or a high school diploma.

Her diploma was not with her during the interview because it was at the university. The consul asked her if she has a high school diploma and

which year she graduated. After that she told her no need to bring it she is approved. CO officers have wide powers to accept anything they want.

Those are 2 strong examples.

Well in addition to being retired she did not meet the financial requirements.

 

Long story short, they were approved on future employment offer and nothing else.

August 8, 2011: NVC received file

September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal
