These are the documents that I'm sending with the I-130 for my Mom. Someone please let me know if Im missing something or I shouldn't include something. I'm not sure  if I have to send 2 passport photos of my Mother. Please advise. 

1.     Form G1145 e- Notification of Application/Petition Acceptance

2.     Form I-130(Petition for Alien Relative) signed by the petitioner,

     along with the following supporting documents;

ü   Check for I-130 filing fee ($535)

ü   Copy of petitioner’s birth certificate (English and Spanish)

ü   Copy of petitioner’s Naturalization certificate

ü   Copy of petitioner’s marriage certificate

ü   Copy of the petitioner’s passport

ü   Affidavit of Translation (Petitioner and Beneficiary)

ü   Copy of beneficiary’s birth certificate (Spanish and English)

ü   Copy of the beneficiary’s passport

ü   2 color passport photos of the beneficiary

@soniavh i dont think you need to send passport photos. I think thats for NVC stage.

I wish I had found this forum before my wife applied for her mother.  She is in the US (like your mother) and is staying with us at the moment.  Before we sent the I-130 we considered sending the I-485 form but was confused by some of the things we read online, e.g. we should send the I-130 first and wait to be instructed to be sent the I-485 after.  

 

We really didn't know if we should've sent the I-485 plus we didn't know what fees to send, e.g. do we send the fee for the I-130 and the fee for the I-485 as well?  We were really confused and still are.

 

Do you know think we should send the I-485 now or is it too late?  We sent the I-130 and thought it was going to CA as we live in AZ but it went to the TX service center and they're showing a 6.5 to 8.5 processing time.  If this information is true, then we may have to file a form to extend her tourist visa which is more headaches for us.

 

In addition to the above information, we sent our I-130 as incomplete since we forgot to attach the supporting copies.

 

Are we screwed?  Should we get an attorney?

 

Thoughts?  Advice?

Form I-130 is a petition that your wife is filing for her mother. Your wife is the petitioner and her mother is the beneficiary. For filing I-130 your wife would need to send a completed I-130 form, with applicable fee ($535), her passport biometric page copy or citizenship copy, her birth certificate and the Mom's birth certificate.

 

Since your mother-in-law is already here, she needs to file for adjusting her status (non-immigrant to immigrant). This is done by filing I-485 (application for permanent residence). This has a fee of $1225 ($1140 + $85 for biometrics). This application also requires supporting material like her (mother) birth certificate,  passport copy,  I-693 medical examination etc.

 

Usually people also file for I-765 (application for employment authorization) and I-131 (application for advanced parole document). The latter is safe to have because the beneficiary may leave the USA and re-enter when the decision is still pending. There is no fees to file these applications when filed with I-485. I wouldn't bother filing I-765 for the mother given her age unless she wants to work.

 

In your case I would call the USCIS number and ask if you could interfile I-485/I-131/I-765. If you can send in these applications, you wouldn't need to extend her tourist visa. She can stay here legally so long as her application status is pending.

 

For filing applications, please use the instructions in USCIS site as source of truth (links listed below). They have detailed instructions on how to fill the forms, what supporting materials are needed, filing fees.

If you haven't received your NOA (Notice of Acceptance) for I-130 or your check hasn't been cashed, I guess they are probably returning your application for insufficient supporting documents. Sometimes, they might send you an NOA and also an RFE (Request for Evidence) asking you to send the supporting documents.

Once you are clear on the status of your I-130 you can proceed with filing I-485/I-131.

Hi,

 

Credit card amount was already debited, and we already received the NOA but no word from them re: insufficient documentation.  Guess I should wait on that before filing the I-485 & I-131?

hi,

   1- My name is usman, i am going to attend my oath ceremony of citizenship in august 21,2018. After that i will apply for my mother to bring her in USA. My question is that i have to fill up  I-130 form only or i have to fill up G-1145 form with I-130?.

 

2 -Secondly My father is expired, so i have to put my both mother and father information? or just to put my mother information because my mother is only the beneficiary.

 

3- Thirdly on my Id card my father name is TABASSAM RASHID BHATTI and on my mother Id card and passport(pakistani) my father name is mentioned as TABASSAM RASHID CHAUDHRY, so which name should i use in parents section of I-130 form?

 

4-what are the supporting documents do  i need to send with I-130 form?

 

Please advise..
