Conditional GC? How do I know?

Hello all ☺

 

So I've just received my visa through courier today YAY! and as I was browsing the timeline and the forums, I came across the "conditional green card" threads, so I got to wonder what I'm about to get.

 

How do I know if my GC is conditional please? And how do I know the conditions?

 

I thought I had PERMANENT residency rights now.....

Timeline

Well from what I know, if it is marriage based and you have been married under 2 years than it is a 2 year conditional GC. You would have to apply for removal of conditions at a later date. Congratulations on having a VISA in hand :D!!!

If the green card is valid 2 years then it's conditional. 

 

And in 2 year you will need to file for removal of conditions. It's a whole, long,  separate process.

06.02.2014 - NoA2

01.04.2014 - Interview. 

AoS

03.2015 - AoS started.

09.2015 - Green Card received.  

RoC

24.07.2017 - NoA1.

01.08.2018 - RoC approved.

If married for under 2 years, you'll get a conditional card. If married for longer, you'll get a 10-year card. Your card's expiration date will be the indicator which one you have. 

Removing Conditions Timeline

Aug. 10, '17: Mailed in I-751

Aug. 21, '17: NOA1

October 23, '18: NOA2- approval

October 30, 18: 10-year GC received

If married for under 2 years at the time you obtain permanent residency, then you get conditional permanent residency and need to do removal of conditions before it expires (filing in the 90 day period before it expires). A conditional resident's green card is issued for 2 years initially.

 

If you obtained permanent residency via an immigrant visa, the 2 year anniversary is from the date you enter the US on that immigrant visa.

If you obtained permanent residency via AOS (filed and adjudicated within the US), the 2 year anniversary is from the date your AOS was approved.

Yes you do have permanent residency rights. But they issue 2-year green cards to couples married less than 2 years at the time of approval. This is to make sure young marriages are genuine and bonafide. If you have a 2-year green card, you need to file I-751 at the appropriate time to maintain PR status and get the 10-year card and then you can apply for citizenship at the right time. Good thing you asked or else you very well could have accidentally allowed your 2-year GC to expire and that would have led to a whole other mess.

Bingo. You can technically file after expiration...your card expires but not your LPR status, but you wouldn't have any evidence of being an LPR. That creates potential issues for work and travel, so it's best to file before the 10 year card expires.

If you obtain citizenship, this goes away.
