Hi,

 

My wife incurred the 10 year bar 212(a)(9)(i)(II) while we were stationed in Japan. I was wondering if there is anyone here with an i-601 timeline. I would love to know what the actual processing times are for Manila. I do have a lawyer handling everything. Currently my timeline is:

 

07/09/18: i-601 mailed to USCIS Nebraska Service Center

07/12/18: USCIS Nebraska Service Center receives i-601 

07/22/18: USCIS Nebraska Service Center cashes check

Can you explain why she received a 10 year ban ?

I started a new thread, i completely forgot the "expedite" part. Anyways, my wife came to the US as my fiance, then we got married. We filed for her greencard but as we were awaiting a response, we had to PCS to Japan. I could not leave her alone in the US so we left together. I asked USCIS over the phone what the repercussions were and she merely said we would have to reenter with another immigrant visa. I said, thats fine, we should have time. On our way back to the US 4 years later, the US embassy in Tokyo denies my wife 212(a)(9)(i)(II). I have no choice but to send my wife back to her home country and PCS with our children. The consular officer says she was denied due to her overstay in the US and departure.
