Your mother has been extremely lucky in the past with multiple re-entry permits being approved back-to-back.  The fact that her most recent re-entry has been approved for only 1 year should be taken as a warning that sooner or later her luck may run out.

 

 

It's in the guidelines that after the first renewal (2-yr) they only issue 1-yr travel documents.  This is not "luck".  A travel document is presumptive intent not to abandon residency.

How many times can it be approved continuously, I wonder?  Right now, OP's mother seems to have lived several years outside of the US since acquiring the GC, and according to the OP only returns to the US to file another re-entry permit before leaving again.

I know that just having one (travel document) helped us get an SB-1 more than a year after the travel document expired - because the rules specifically list that as grounds for intent to maintain residency. 

My fault, not my wife's, that she was out so long. 

We went through great pains to maintain ties to the US.  As long as she is filing taxes on her overseas income, maintaining property/ a US residence, banking, and able to demonstrate that she does not intend to abandon residency - as well as maintaining her travel document that is all she can do. 

With that said - eventually they will deny the renewal and at that point she will have to choose.  I agree that for her sake it would be better to voluntarily trade in the green card for a tourist visa than to try to get a tourist visa after they deny a travel document.  She's playing the odds however she has another year to decide what she really wants to do.

I was tempted on this but our business is immigration and immigration experience.  Everything else catches up eventually LOL

And meets physical presence test.  Using bonafide residence in Thailand WILL catch up.  Can't have it both ways.
