We put N/A and left no blank spaces. We included 4 photos. 2 for AOS and 2 for EAD.  Also, make SURE you check that you are using the most recent forms. I know that EAD just changed recently. Good luck!

The people reviewing your EAD/AP will not have you AOS things to look at. They are separate applications and go to different places.

Ok thanks, I just found a really good site.

http://nightwalker.me/SawadeeVisa/FilingAOS.php

It breaks things down a lot. I'm glad you told me this. I honestly though I just included the forms with the AOS packet itself.

I would be careful using that site.  There is misleading information on that page.

"K-1 Nonimmigrant Fiancé(e) of U.S. Citizen or K-2 Dependent--(a)(6). File Form I-765 along with evidence of your admission (for example, copies of your Form I-94, passport, or other travel document) and your K visa. You are only authorized to work under this category during your 90 days in K-1 or K-2 status. You cannot renew this EAD. If you submit subsequent EAD applications, other than for replacement of a lost, stolen, or damaged card or a card that contains incorrect data, you must apply on a different basis. If you have a pending application for adjustment of status, you should file under category (c)(9)."

It took a minute but I FINALLY found it from the official site. Looks to be just two pp style photos, i-94, and K1 visa page and passport biographic page same as what @Wuozopo posted. Does that all sound pretty accurate? I really don't want them to RFE us or worse deny it. I don't want to include to much info for these two because they'll have pretty much everything with AOS.

No, no, no, no, no. Do NOT file I-765 on the basis of being a K-1 holder. It'd expire before you ever received it (it's only valid for the 90-day period after POE, so it's totally useless).

File it as category C9 (Adjustment of status applicant).

I want to make sure we do everything perfectly especially since this new policy is taking affect. Could you guys just look over what we will be including and tell me if I need to add anything. Also, I've seen some people include their medical results and their police certificate. Is this necessary, would it hurt? Also can I just do one check for the amount of $1225 or does it have to be two separate checks? One for AOS fee and one for biometrics?

Our packet will include....

  • Cover Page
  • Check
  • Two passport style photos
  • G-1145 E Notification
  • Form i-485 Adjustment of Status through K1 Visa
  • Complete copy of passport
  • Copy of passport page with K1 Visa
  • K1 NOA1 Recipet
  • K1 NOA2 Notice of Approval
  • Copy of updated i-94
  • Copy of his birth certificate
  • Copy of marriage certificate
  • Picture of us on our wedding day (I know not necessary just wanted to add a little personal touch)
  • i-864 Affidavit  of Support (along with a letter from my bank, a letter from my employer, copy of my last 3 recent tax returns, last few pay stubs (maybe last 5?), and bank statements from a year).
  • i-765 Employment Authorization Document
  • i-131 Advance Parole permission to travel

Does that look good guys?

Picture not necessary unless you want. Looks good but you have to individually pit the docs attached to each Application Form like I-485

> NOA

> NOA 2

and the rest

same with I-765 & I-131. That’s what I did and I have notice for Biometrics already

So what all needs to be included with our EAD/AP applications other than his K1 visa, the bio page in passport, two passport style photos and his i-94? Our marriage certificate? I just need to know if I need to put everything I send with AOS with them as well or just those things will be enough? I want to do this right and I'm still confused as to what all needs to be sent with them.

Did you look at the link I gave you? Did it open? Did you read all of it? That's all of the evidence with each.

Yeah, I actually printed it out. I was going to use it as a reference point to help me assemble it. I just want to make sure I'm doing everything correctly.

We weren't going to file under K1. We were going to file it with the AOS packet.

Instructions for I-131 https://www.uscis.gov/sites/default/files/files/form/i-131instr.pdf

Start on page 8. Read

**How To Fill Out Form I-131

**1. Initial Evidence

All applications must include a copy of an offcial photo identity document showing your photo, name, and date of birth. (Examples: Your current Employment Authorization Document, if available; a valid government- issued driver’s license; passport identity page; Form I-551, Permanent Resident Card; or any other of cial identity document.) The copy must clearly show the photo and identity information.

[page 9]

**c. Advance Parole Document for Individuals Who Are Currently in the United States

If you are in the United States, you must attach:

(1)  A copy of any document issued to you by USCIS showing your present status, if any, in the United States  [I-94, K1 visa]

[page 11]

**2. Photographs

If you are outside the United States and ling for a Refugee Travel Document, or if you are in the United States and filing for an Advance Parole Document:

You must submit 2 identical color photographs of yourself taken within 30 days of the ling of this application. The photos must have a white to off-white background, be printed on thin paper with a glossy finish, and be unmounted and unretouched.

If they wanted your marriage certificate, it would say so because they say a helluva lot and most doesn't apply to your situation. You are not a refugee, outside the US, and such as that.

@Brittani What helped me get through the whole immigration process without one RFE was printing out the whole set of instructions provided by USCIS. Then I would read through and highlight what seemed to apply to me, much like I marked the copy above in bold.

I would also mark out whole, sections with a giant X if I knew it didn't apply to me,  a K1 in the US.

Not a refugee X

Not DACA X

Not outside the US X

Not returning resident X

When you mark out paragraphs and pages that are not about you, it makes the instructions a more manageable read when you go over it a 2nd and 3rd time focusing on things that  fit you. It's a lot of bother, but that was my way of getting it right.
