I filed k1 in 2009. We were married in 2010. He got his green card in 2011. It has been only about 7 years since the original i-864. He hasn't had a full time job this whole time either. So I believe that would reduce the quarters of work he has had. 

 

That being said. What can I do going forward?

I just google how much you have to make in a quarter for it to be a "qualified quarter of work" (which is 3 months) The total for 2018 is $1320 per quarter. That's less than I expected it would be. So looking at the fact it's been about 7 years since AOS and the i-864, and this petition process is going to take at least a year. By that time I will be almost off the hook.

I only used the space provided and 2 more sections in the additional information form they now provide and I got an approval just fine. I didn’t add any separate piece of paper for how we met. I assume they just want that part to be clear, concise, straight to the point.

That's the minimum amount for the quarter to count. If he makes more than that per quarter then it doesn't make the quarters go faster. He still has to be credited with 40 qualifying quarters. 

 

Likely he has become a USC by now anyway. Or left the country for good. Both of those relieve you of the responsibility. Note that the responsibility is only to the government and only if he accesses public funds. The fact that he has been here 7 years without claiming anything so far suggests that he is financially stable here and has no need for food stamps, etc. In reality the government rarely pursues the sponsor even when the immigrant does access public funds. It's just not cost-effective.

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

Do you have any idea about my initial question? How I would get access to my old petitions and his A#? Or doesn't it matter? Can I just leave the A# blank and put an estimate in for date filed?

It is my opinion that  "unknown" is an acceptable answer when you don't know...like a parent location or birth date when you never had contact with that parent.  You do not know the A number. Say unknown. Estimate the other dates. You were married to him. Surely you can get a close guess. You can also say "See further explanation" and explain you lost contact and do not have any of the paperwork so your dates are approximate.

 

Social Security does not use the term quarter as literally as it used to when you had to work in the 3 month time frame of a quarter to earn the credit.  Now $1320 is a "quarter" and $5280 is "four quarters" BUT if you earned $5280 in January and did not work during any of the other three quarters of the year, you still get credit for four quarters.  So chances are even at part time, your ex is earning four social security quarters each year and would get you off theI-864 sponsor hook after 10 years.

So for example if it was you+2" kids+ new immigrant+"other" (the ex), you have to earn at the level for a household size of five.

This was incredibly helpful! Thank you so much! Yes I remember approximately when I sent in the petition. I think I know the month. Not the date. I will make an explanation in Part 8 additional information that the dates are approximate. Thank you for your explanation of a quarter. Yes I'm sure he made/makes enough for qualified quarters of work at least he did when we were together. So I just have about 3 more years to go. 

 

So when it comes to filling out a new i-864 when my fiance will have to adjust status my household size would be 3 if I don't have any other dependents? Looking at the hhs poverty guidelines 125% for 3 people is $25,975. So as long as I make more than that I'm good?
