I filed a 130 for my daughter over 21cthat lives in russia but born in Moldova but listed her address in russia filed it along with all the proper docs. over the years I recieved a receipt and number  i-797 approval noticewith a jan 2012 receipt date ans a sept 2013 approval notice date after forwarding DDITIONAL INFO

 

i Just reread the I-797 noticeof action dated sept 2013 indicating the petition was approved BUT In the middle of the document which i didnt notice prior to today it says" the information submitted with the petition shows the person for whom you are pettitioning is IN THE UNITED STATES AND NOT ELIGIBLE TO FILE FOR AN ADJUSTMENT OF STATUS". IT ALSO SAYS SHE SHOULD FILE FORM i-824 IN SMALL PRINT.

 

please tell me is her immigration petition in trouble? what does this mean?

filed 129 with vermont 4/19/06

first notice 5/3/06?

something must have been filled out incorrectly because the approved i130 never went to the NVC or National Visa Center for the second part of the process

 

you will now have to fill out the i824 so that uscis will send the form to nvc for the second part of the process.

 

you should have received a letter from NVC with the new case number once the i130 was approved

 the approved 130 never expires

 

the whole process is 7 or 8 years, so you are still in time to get the approved i130 sent to the NVC

 

file the i824 as soon as you can
