Hello

Im wondering if anyone can help with this-

I am a britush citizen married to a US citizen living in the US. We recently had a daughter and are wondering if she is entitled to British citizenship? If so how do we go about it?

Provided her father meets the residency requirements for passing on his USC status to a child born abroad, yes.  The process is  CRBA

You need the instructions for the UK: https://www.gov.uk/check-british-citizen

 

It depends on how the UK citizen acquired their citizenship, and where and when  the child is born.

 

If the British Citizen was born in the UK then usually their child can also claim UK citizenship. 

 

But for example, my daughter who was born to a British mother (me) in the US and became a British Citizen through me cannot automatically pass on her citizenship to her own children if she gives birth to them outside the UK.

 

If your daughter is eligible then simply apply for her UK passport.

Thank you for your response. She was born this year and in the US. I filled out the form, and it says she is probably a British citizen by descent which mean I should be able to just get her passport right?

But doesn't she need a UK birth certificate to get her UK passport? Does this mean I have to register her in the UK?

Yes, she is!  My children are dual citizens through their father, my ex, who is also a dual citizen born in the UK to an English mother and an American father.  

 

They are now 17 and 22, and both got their British passports before the age of 16.  I believe that it was a bit more involved for my younger one, as the security/process had changed by then.  It was all done online though, from within the States.  I seem to remember also that it was important to do it before they turned 16, as at that point they would be considered adults by the home office.  I may be wrong about that.

 

Even with the Brexit, I feel that it has been an advantage to them.  My older one just did a post-college trip round Europe with friends, and there were discounts, shortened lines, and other perqs to having both US and British passports.  My younger one recently travelled back to England with his father using the British passport, and also thought it saved time in queues, etc. 

 

They also both really identify with their British nationality.  It is a connection and source of pride with their family on that side.

 

Edited to add:  My boys do not have British birth certificates at all.  They were both born in Seattle, and their US birth certificates were used.

She doesn't need a UK birth certificate for the application - just her regular American one is fine showing both parents. The UK parents will need to include their long-form birth cert and/or passport (we were also asked for our marriage cert - although it wasn't on the list of documents needed) 

 

Just do the application - as long as the UK spouse didn't acquire their citizenship by descent then it should be fine. 

 

Your daughter will only be able to pass on her British citizenship if she gives birth in the UK (long way away I know!)
