HI! I HAVE A QUICK QUESTION...

IT IS MY UNDERSTANDING THAT FOR THE I-134 VISA I NEED TO MEET THE POVERTY GUIDELINES FOR '07 AT 100% (AND THATS WHAT THEY LOOK AT FOR THE INTERVIEW) AND THEN WHEN WE ARE MARRIED AND I FILL OUT THE I-864, I NEED TO MEET IT AT 125%.....?? (WHICH I CAN DO WITH A CO-SPONSOR)

CAN SOMEONE PLEASE CORRECT ME IF I AM WRONG, OR ANY OTHER INPUT WOULD BE WONDERFUL TOO!!!

Since the K-1 gets handled by the immigrant visa unit at the consulate they tend to hold the evidence to the higher standards of the I-864 so expect the income level to be above %125 poverty line, even for the I-134.

If you plan on a co-sponsor for the I-864 why not have them do an I-134 and provide it to sponsor the K-1 visa?

I was also under the impression that you have to meet 125% for the I-134 also

ive got a different question.... can one use money in a trust to meet the requirements? its there, im just not sure where that would belong under.

Nov 29, 2007 AOS paperwork sent

Dec 3, 2007 NOA for AOS and EAD

Dec 22, 2007 RFE

Jan 15, 2008 RFE returned

Jan 25, 2008 RFE recieved, last touch on AOS

Feb 22, 2008 EAD recieved

Mar 29, 2008 AP application sent... late but just in case

May 2008 AP approved!

Sept 5, 2008 AOS approved!

Maybe, if the money can be removed from the trust on relatively short notice, say a year of less (the I-864 guideline for use of assets, which doesn't necessarily apply to non-immigrant cases).
