Hello Everyone

I'm new to the forum and am very glad I stumbled upon it. It is good to find a place where others can share their experiences with this whole visa process.

My husband is in the Dominican Republic and I am going to be starting the petition process shortly. I am a bit confused as to which way to go for his visa process. Is it better to petition him with a K3 visa or IR-1? I'd like your advice. thanks

It depends on your situation. If you're looking for speed (to be w/your spouse quickly) then I would suggest. However, if you are looking for the best overall visa then the CR-1 would be the best choice.

We chose to do the CR1 because although the waiting period might be longer once he arrives he will recv his green card and ss card w/in a month and we could focus on our life together instead of add'l immigration paperwork and headache.

If you have been married for less then two years AT the interview then your husband will get the CR visa. If more then two years then he will get the IR visa.

01/06/07 - NOA1 ($190)

05/16/07 - NOA2!!!!!

NVC: CR-1 Process

05/21/07 - NVC recv'd case (per rep @ NVC)

05/29/07 - NVC Assigned Case # (KNG2007******)

06/01/07 - Faxed change of address request to NVC

06/08/07 - NVC confirmed new address

06/18/07 - DS-3032 (Choice of Agent) & AOS (I-864) Fee Bill generated

06/23/07 - Recv'd DS-3032 & AOS Bill via snail mail

07/09/07 - Emailed DS-3032 (Choice of Agent) to NVC

07/19/07 - Mailed AOS Fee Bill ($70) to St. Louis, MO

07/19/07 - Recv'd email from NVC - Choice of Agent was accepted

07/23/07 - IV (DS-230) Fee Bill was generated

08/11/07 - Recv'd IV Fee Bill via snail mail

08/15/07 - Recv'd AOS Packet in the mail

Look at the timelines for your particular country Dominican Republic is one of the slowest consulates (400-600 days)

Probably do the process for K-3, and when you do get approval for the I-130 (IR-1) file I-824 to to keep the IR-1 moving, when it reaches the consulate, they will combine the K-3 and IR-1 together and the resulting interview will be for the IR-1 which will save you the time involved in the AOS for green card.

The K-3 tends to get through NVC to the consulate faster than IR-1, this would get in the queue a bit faster, then when the IR-1 case dose show up it will be put with the K-3 case. "in theory"

We just went straight for the IR1; we didn't want to have to deal with adjusting status and we live in the same country so reuniting quickly wasn't really a concern for us. I think people should do K-3s as a last resort personally!

Thanks for the info everone, gives me a place to start and do my homework and research before I start the process. I got married a month ago in the Dominican Republic. We've known each other for a year now and have been in contact since we met. I will be going back to the Dominican Republic next month and hopefully will have all his paper work so I can bring it back with me and start the petition process. I will take all the forms I can think of with me so we can review them together and he can sign the necessary forms. If anyone knows something else I should be doing please let me know.

For people living together in the same country like you are, unless there is a compelling reason to hurry back to the US, I would agree. For those living half a world apart and waiting to start a life together, the difference of a few months often becomes far more important.

People looking for answers in the K3 forum are far more likely to be in the latter circumstances than your own.

Facts are cheap...knowing how to use them is precious...

Nothing is better I think everything is the same due to the backlog that the Dominican consulate have, you can be approved here in one month, but you have to wait 12-24 month just to get an interview. I'm so dissapointed with this situation too. I cant beleived that this is happening to me, I think is better to go and get tourist visa and then do all the paper work here.

I would add that since the process takes 20-24 months in the DR, like most here have mentioned, the CR or IR visa is the way to go and the suggestion to file the K3 was right on the money. They are actually harder on the K1s at the Consulate it seems and the time difference is little if any with the wait being so long. The added benefit of not having the hassle of AOS is just icing on the cake.

Twincactus, Did you go the CR/IR visa route? would doing the k3 visa route be worth it? I'm sorry if I'm repeating the same questions, I just want to be clear so I can decide which option is right for us. He is in the Dominican Republic and I am in the states, we were married last month in DR. This is very frustrating and it really stinks to be apart from your loved one for so long. Do you know if the processing fees will definitely be increased next month? Thanks. sorry for all the questions. by the way I love this forum, it really is very informative and helpful. Thanks for creating it.
