Hello all 

I’m thinking of moving forward with K1 visa but has some concerns. My income 2016 was 65k annually but then I had a work place injury & been on SSDI ( disability not Welfare ) disability pension from my employer as I had to medically retire. Of this only the employer pension was taxable which is only 8K annually even though my gross is 35 K including disability but is not shown in tax return. So can I just provide all the disability papers along with my assets ( cash assets including stock & bond alone will be 40K not including my equity  ) or do I need a co sponsor ? Thanks in advance.

If it's constant income, provide proof and you should be fine. Remember assets have to be 3 times the income. So if you're only using assets adding up to 40K, that will not work. You will need a co-sponsor.

Whether or not you need a cosponsor depends on your household size. I'm sure you are able to prove you have a gross annual income of 35K? Like TNJ17 said your assets would have to be 3 times the income to be considered.

Hello everyone.

Need some advice. I think we have chosen the wrong visa type but too late now. 

I (male beneficiary) and my partner (female US citizen) are living together currently in Australia. And have been for two years. We have one child and another on the way. Getting married in the USA in April 2019. I'm working full-time and she is working three days a week until November due date. But all that will cease once we relocate to the USA around March.

How do we meet income tests? It has to be current employment? Should we just get a sponsor?

I was hoping to get ead straightaway and find work but have recently discovered it may take five months to process. She was planning to take a year off work to look after the babies. Therefore both not working until Ead/ AOS processed...

My thinking is we can't use our Australian income as proof as that will cease once we leave. Our assets aren't high enough. Partner won't have a job before we move over and I can't get a job until Ead. What's our options?

You need either assets or a co sponsor, or your partner needs to return to the US beforehand and find a job that meets the requirements.
