I forgot the 2 photos for I-131 - what to do?

Hello

I filed I-485, I-765 and I-131 together and just received the receipt notice. Now, I found out that I needed 2 photos for the I-131 which I haven’t included. (I only included the photographs for the I-485 and the I-765). Does anyone know from someone in a similar situation?

One lawyer suggested to retract the I-131 and then re-file it. But I‘m a bit hesitant because I don‘t want my process to be messed up.

Any suggestions are highly appreciated!

Thank you very much!

I honestly only sent 4 photographs with my initial package, which came back at first because I didn't use the latest update form for I-765. In my green slip notice where they say what went wrong in my application, nothing was said about the photographs.

I sent it back, with the correct version of the form afterwards, still with the 4 photographs and it got filed and already did my biometrics in a matter of 2 weeks or so after filing. I could show you how I did my package and what I included, if you want. I know it took me forever to gather enough info to make everything right..

I had forgotten to put 2 photos for I-131 but It had been approved without any rfe. But, it does not mean that you won't get one. You may or may not, it highly depends on the officer that handles your case.

Hello Magdalena

Thank you very much for your response! Yes, it would be great to have a look at your package if possible. I carefully read the instructions but I honestly thought the photos are only necessary if you ate outside of the US (didn‘t read the second part of the sentence). It is good to know that I‘m not the only one!

Hi Gravlax

Yes, you are right. Every case and officer is different but it is very good to know that there are cases which got approved without the photos. When did you notice that the photos were missing? Is your case recent?

Thank you very much for your help!

If the officer assigned to your case thinks that the photographs are necessary for his review, then you will be issued an RFE indicating to send the photos along with the cover letter. Do not listen to the attorney and recall the application....any monies paid will not be refunded.....this may cause you to re-file and pay again.

First of all, I agree with Amadia... They WILL send you an RFE if they need more from you. Timewise, I don't think it's faster either to recall you application and then send it back. It's just that you will have to wait and see if they request the photos or not.

Secondly, I'm posting here the contents of my package. Hope it helps a little. I attached a photo to see how I clipped everything: keep in mind that I put it like this ONLY after I received my package back the first time due to wrong form date, so I saw how they stapled everything I sent in a completely different way than I have sent it; I will attach pictures with all 3 content letters that I attached to each application in my package.

We decided to pay with a credit card, so I attached the G-1450 right on top of my I-485 bundle. ( the reason I put the stickies was to make it sure I won't have issues with the return of any of my forms due to not being the correct fee, as I have read in other people's posts) I wrote down the fees and the waived fees for the forms and the EAD category of eligibility.

Put them in the order in the package.

I noticed it just after sending my package, which is in December. Then, i decided to wait. I thought like RFE process will cost me the same time with recalling and reapplying process.

I just found this. I don’t know if the information is up-to-date but it would solve my problem:

Combo Card

...But wait, here’s a benefit! (A small one.) If you were to submit separate applications for and EAD and for AP, you would need to include two identical, passport-style photos with each application. These usually need to be professionally done, in order to meet the size and other requirements. But when filing the two applications concurrently for the combo card, you need to provide only two photos.

If you want a combo card, you don’t need to specifically ask USCIS for it. Simply include both Form I-765 and I-131 with your adjustment of status application. USCIS will do the rest.
