Hi All, 

 

So I received my rejection notice for my I-765 that I filed with my I-485 application. I'm going to refile it again and include my NOA1 from my I-485 so that should cover the fee issue.

 

Questions are this:

- Do I only include the green notice letter they provided or do I send back the whole stapled bunch (NOA rejection, green letter and previous I-765 form) ((they never returned my supporting evidence and passport photos I originally sent)) 

- Do I need to provide another 2 passport photos?

 

Thank you in advance. I'm a bit annoyed that they didn't see my C9 category and also filed I-485 but hey ho!

Hi there. The exact same thing happened to me and that is why today I got approved for my i-131 but the i-765 will probably be approved another time (whenever that may be) instead of getting the combo card, but yes, I just sent back the green letter, a photocopy of the NOA rejection and I basically just filled out a new i-765 form with new passport photos and supporting evidence (They never did send back all that stuff with the rejection letter 🙄)  I even made a photocopy of the approval NOA for my pending i-485 and it was accepted (I also attached a handwritten note telling them that I did send the correct fee because I filed it together with i-485 and i-131. I would advise you to redo this and send it back asap. Hope this helped.

I thought as much but was hoping to not have to get more photos taken. Oh well! Thank you so much for your help. Hopefully they notice the re-send and still send the combo card. To say they have a paperwork reduction act....they definitely waste so much paper haha!

check if you used the latest form for the EAD. it was likely not the no fee but rather an outdated form that caused the rejection. i know it doesn't makes sense, but there were several reports on here from people who encountered the same issue. and one person actually called USCIS and was informed that the rejection letter is a standard template that (even if it's not the case) talks about not sending a fee even though the real reason was the outdated form.
