Dear All , 
I need help as I'm a Pakistani guy and got married with my far relative whos American Born but she's just a student there and his father and mother lives outside from America. We have applied for CR-1 Visa and our process is on last stages but I Am confused over NVC stage that I have applied for DS-260 form with all requirement's and I got Notification as well that NVC is now Assessing my documents , but in Affidavit of support ,since my wife is just a student so she don't really do any job ,instead of her I have manage to arrange cosponsor who's my uncle we have have submitted AOS From, utility bill for Domicile proof ,his passport copy and W2 Form as well. but still the Status showing NOT SUBMITTED , why ?  And should I also have to fill my wife AOS since she's Petitioner ? I've attached the picture as well please advise is it normal ?

hi

 

your wife as the petitioner should have filed an i864 regardless if she has income or not and attach a letter explaining why she wasn't required to file taxes

 

along with that, your uncle had to submit his i864 with taxes and financial evidence. they are submitted together.

Affidavit of support shows as "not submitted" because your petitioner has not submitted the required forms and documentation.  Petitioner is always primary sponsor, whether they qualify or not.  It's a "contract" that must be signed.

Facts are cheap...knowing how to use them is precious...

OK so my petitioner should also have to submit the required AOS with a letter that she's just a student? 

In the AOS section income and tax section what should I write?

Yeah my uncle submitted IRS tax form along with W2 as a supporting document for AOS. My question is should my petitioner should also have to submit Affidavit of. Support form? Since she's just a student she doesn't have any job.

Yes, she must submit her affidavit of support even though she doesn't make enough. She has to file her taxes or a letter explaining why she was not required to file.

If she didn't make any money during the previous tax year, then you put in $0, same deal with current income.

➺ 01/23/18 Case number and IIN assigned! 

➺ 01/25/18 DS-261, choice of agent  filled 

➺ 01/26/18 AOS bill invoiced

➺ 01/27/18 AOS paid 

➺ 02/01/18 IV bill invoiced and paid

➺ 02/07/18  DS-260 completed and submitted

➺ 05/11/18 AOS and IV packages sent (EMS from Indonesia)

➺ 05/16/18 IV and AOS package delivered to NVC

➺ 05/23/18 Got CC at NVC!  

=============================EMBASSY=====================================

➺ 05/31/18  Interview date assigned 

➺ 06/29/18 Medical Check (a week later the RS.Premier Bintaro sent the result to US Embassy)

➺ 07/31/18  interview!-- CEAC showed "Issued" a day later

➺ 08/03/18 Visa in hand

➺ 12/16/18 Point of entry: Houston
