I think the sponsorship issue has been mentioned a few times.

Not mine! :P She's not one for weddings...the one we had was enough. haha

So you’re saying that my brother in laws salary thing could not effect my sisters application? Hmm makes sense but Kinda confusing cuz my sister is already employed and showed her own salary so maybe she got refused cuz the officer thought what would she do alone in US.

 

so guys, Temme one thing. They are obviously gonna reapply. Is it okay for my sister and her daughter to reapply and keep her husband out of the equation?? Can we show that her father in law is sponsoring? But it would seem weird that she would say that she’s taking her daughter by herself to US tho. Thoughts?

I posted something in a India b2 thread a few weeks ago, and having lived in India for a number of years it bears repeating. Agents do not help. They promise you the moon, but they cannot guarantee anyone a US visa. So, that was the brother in laws biggest mistake. If the sis/bil are educated, there's no way they couldn't have completed the simple ds160 process. Or perhaps they paid someone to do the work, which is a common concept in financially well off Indian households.

 

Additionally, Indian nationals tend to play the numbers game. A first or a second visa denial is usually not a deterrent, as noted by OP's "they're obviously gonna reapply" statement. However, the odds of the next CO suddenly approving a visa mere weeks following a refusal are slim, unless there's a significant change in the applicants' circumstance, which doesn't appear to be the case. 

 

Of course sister's family could reapply, but I'm skeptical. Good luck however. 

 

ANd one final thing.. there is no sponsoring a b2 visa!  Pretty much Indian applicants use that term for the most part!

Hi Amit, I feel your pain. My husband's brother was denied a tourist visa for our wedding and there weren't even enough open interiew slots for his parents to have a chance. They weren't able to attend our wedding. :( 

 

I'll add that the reason for the tourist visa application (wedding in US) unfortunately makes zero difference to the person approving the visa. It will not improve chances for approval or expedite anything. Think about it: officers in India probably hear that ALL the time.

 

The US government doesn't care about why people want to come. They just care about why they will go BACK to their home country. Unfortunate, but true.

attending a wedding or sightseeing affects little on the visa issuer's perspective.

 

The visa officer was not convinced that your sister's family will return. No judgement but the visa officer may see these:

 

You mentioned your niece's school issue a letter saying she will be on holiday and return, however the headmaster has no power to ensure your niece's return, so the letter carries little to zero weight.

 

You said they own property, which could easily be sold.

 

 Your sister's husband being a  salaried professional, unless he makes a **** loads of money, even a minimum wage maker brings home a lot more than a white collared Indian.

 

It's unfortunate that many families won't get to attend their loved one's wedding.

To be honest nothing they do will get you a different outcome. The reason they got refused had nothing to do with them not mentioning your wedding. They couldn’t show proof of strong ties to their home country so if you don’t change that they won’t get approved for tourist visa. Truth is that applying for a tourist visa so soon after a denial will only just cause another denial. If they don’t change what the CO didn’t like the outcome won’t change. If the CO doesn’t think they show strong ties that’s probably because they don’t. Your niece being enrolled in school, your brother in law having to take care of his folks are not enough proof. If they don’t have steady jobs with steady incomes to show they would lose so much if they stayed in the US is mainly what they’re looking for. They already see them as probable red flags because of your K1, and yes they do know. Even if you didn’t mention it. I think you should cut your losses and maybe go back to your home country for another ceremony after you get AP when you get here.

It sounds like your brother's application was weak and he could have made a stronger case. That's unfortunate. Instead of waiting to be asked for proof, your brother should volunteer as much evidence as he can. Whatever documents shows property ownership, proof of his job, etc... They may be denied again but all you can do is try again. And try to make a stronger case that your brother's family have compelling reasons why they would return to their home country. And that case needs to be made "in the file", with documents. Don't plan on being able to explain it at the interview. Try to make it obvious to the CO before they even walk in the room.

If your family recently applied for and was denied their tourist visa application, it is very slim in the chances of them reapplying without waiting some months. The reason is, the situation usually does not incur major changes in the situation and the officer can still deny the application.

Remember, the US government has ALL applicant's information and attending a scheduled interview simply acts as a formality to affirm applicant's details. They already know why they will deny the application, they already scrolled the file and have already made the decision long before they see the applicant at the interview.

Quite the opposite.. do not volunteer, but if reapplied and asked purpose of visit, say wedding. Do not lie! The sis/BIL have already screwed it up by not mentioning the wedding (wrongly assuming it'll negatively affect the K1). 

COs don't look for documents, they look for credibility of the applicant.

No point volunteering documents that the CO doesn't ask for...they won't look at something just because you put it in front of them.
