Need assistance for AOS.

Hi everyone. My current immigration status is J1 Out of Status. My husband (USC) and I decided to just file my paperworks ourselves than hiring a lawyer to save money. 

 

 

After reading a couple of topics in this site, we've gathered the forms to be filed below:

 

 

• Form I-130, Petition for Alien Relative
• Form I-130A, Biographic Information
• Form I-485, Application to Register Permanent Residence or Adjust Status
• Form I-864, Affidavit of Support
• Form I-693, Report of Medical Examination and Vaccination Record
• Form I-765, Application for Employment Authorization (optional)
• Form I-131, Application for Travel Document (optional)

 

Questions:

1. Can somebody check if we miss anything? or if you can share the link with the complete list of updated forms to be filed would be very much appreciated.
2. Can I send them all in one package?
3. For I-693, Should I wait until USCIS requests the medical exam report? OR do I need to submit it with the rest of the forms?

1) I believe you have them correctly. you can download all the form on USCIS homepage (https://www.uscis.gov/forms?topic_id=1130)

3) It's the best you send it together with your packet

I agree with 1 and 2 but for 3) it really depends on your local office,  and I will beg to differ.

I see you live in Nevada, I am not sure what your local office is, but for example for Las Vegas, NV it takes 12 to 24 months for the full process. We all know processing times are not always accurate but in general, AOS takes between 9 to 18 months, and medical I-693 are only valid for a year.

So my advice would be to send your package ASAP, so that you can be back " in status" and in line to receive your EAP and AP combo card and wait when they schedule you for an interview to do the medical. Medicals are expensive, usually $300-500,  it will suck to do it twice.

You can bring the medical to the interview with you, with no pb. After you receive your NOAs and do your biometrics, you will receive a courtesy letter to let you know to bring the medical to your interview or when they will request it for you.

True. I didn't send my I-693 since there's no opening spot for the medical center I went to, i had my medical done on May 28 (it cost $350 for me and they said they are guaranteed to renew for me if it expired). Since I already mail out my packet on May 15, so I have to hold on the medical report.

I received a courtesy letter on Jun 20 for the I-693. Today got a status update "Case is Ready to Be Scheduled for An Interview", I hope I will get interview notice soon so my report won't expire

This is such a great help.  One more question, does the cost $300-500 for medical is with insurance or without?

You are welcome 😉I dont think the medical exam is covered by insurance, unfortunately you have to pay out of Pocket and choose a civil surgeon  out of the list of doctors verified by USCIS

Mine was covered by insurance, but I had to pay the $65 co-pay (twice) and then $75 for a tetanus shot

Wow lucky you! I tried but my insurance said no and none of the civil surgeon listed by USCIS were covered by the insurance.

do you have J1  2 year home country requirement? Did you need to obtain "no objection letter" for 2 year home country requirement?
