Such affidavits carry little to zero weight in the overall evaluation of file; skip it in favor of evidence (you are submitting evidence, not proof) of time spent together in-person (which you have plenty of).  If you ultimately chose to submit the affidavit, it does not need to be notarized.

I see this statement come up a lot here in VJ; however, I recently emailed USCIS here in Lima about doing a DCF and in their response they specifically mentioned affidavits in their list stating "Evidence of the relationship with your spouse, such as photos, affidavits from those who are aware of your relationship, etc. "

Have your husband apply for an ITIN (Individual Taxpayer Identification Number) number  (IRS form W7) for you.  It is not a social security number, but will give him a nine digit number number to use on his 2018 tax return to claim you as spouse.  Canadian government does not have a similar process but you can put him on your return as spouse on your 2018 Canadian return with a SIN number of 111 111 111.  These can be used as proof of joint tax returns during your interview in Montreal (and removal of conditions 2 yrs later).  Once you enter the US on a CR1 and get your SSN you can replace your ITIN number with your new SSN number the next tax filing.

Honestly, I think you have enough. The fact that you lived together for a year & have some proof of that is great. Also adding a spouse to benefits is good. You can add photocopies of passport stamps. You don't have to get the affidavit notarized, but I would include it if you have it already, can't hurt. I'm almost 40 & don't have a will lol...I also didn't submit tax returns to USCIS. I would include photos with each other's families & friends if you have. But delaying the start of the process to get a will or tax returns, I don't think is necessary.

My wife's interview is soon and evidence of interview is all I can think about now.

We have

  • Pics
  • Joint Tax Return
  • Joint Lease
  • My wife is a Beneficiary on my 401K
  • My wife is a Beneficiary on my Life Insurance
  • Travel Itineraries
  • Chat Details (really hard to print these out).
  • Some emails (mainly about our travel plans together).

Couldn't open a bank account together. Bank wanted proof of her residence and lease wasn't good enough proof for the bank. I really hope this is enough.

Good lord people this is IR1/CR1 for a Cdn/Am couple, not ROC! The consulate doesnt expect newly weds to have wills etc... To be honest I cant remember the last time Montreal even asked about evidence at an interview.

For the i-130 provide evidence of time spent together.  Since you lived together for a year, anything showing you lived at the same address, photos etc... will be most beneficial.

I filed our i 130 earlier this month. My husband lives in Romania and I'm here in the US. We have none of the proof listed as we've never lived together and he does not have a tourist visa so he's not allowed to visit, therefore I can't just add him to financial documents, like a bank account. It's all very frustrating. I submitted the marriage certificate, photos of all of our time together and the marriage, and affidavits from 2 of his family members and 2 of mine. Hipefully that will be enough...
