Nope. The I-134 signed for the K-1 visa is not enforceable. Only the I-864 (for an immigrant visa or AOS) is...and only after they get the green card.

Maybe this time she should consider being the one to move, see how it goes without any additional consequences or expense.

 

I 134 may be unenforceable but I think he still counts a plus 1 for affidavit purposes.

Likely a judgement call by the CO...the I-864 instructions only states "If you have sponsored any other persons on Form I-864 or Form I-864EZ who are now lawful permanent residents, enter the number here" to calculate the household size.

I would wonder if she met the second guy and just decided she liked him better so is doing it over. Also, perhaps she was not very committed and chatting with the second so her husband got fed up and decided he couldn't stay married to her. I'm not saying this is true but looks suspicious. I think she needs to take some time. People sometimes confuse infatuation with love even with the best of intentions.

you wonder wrong. Her husband had girlfriends in two different states and a child that he lied about in his country he ran from. Nothing suspicious here you all want to assume that the other guy had anything to do with this. My friend got used to enter usa thinking that she was loved and the person was loyal to her. her ex husband is piece of (removed) liar & liar he had this all planned out sin the first day

You said earlier that her husband was clueless and didn't understand anything about the whole process and now you're saying that he schemed and planned this all so I don't really understand but I wish the very best for her.. I think that she would have better success with immigration and marriage if she just took a little time for herself and maybe got to know this person a little bit longer since you say that the relationship didn't start when she was married. it would be terrible for her if she ended up with another jerk who treated her badly. She's fortunate to have a good friend.

I am truly sorry if I offended you. You know your friend much better than I do and if you say she has a good heart I believe you. People with good hearts and good intentions are often taken advantage of. This happened to her once. It would be a shame if this happened to her again and then she finally met a really good guy that was worthy of her but in a position of trying for a third K1 Visa. Hopefully this new man in her life will be patient and think of her first and give her what she needs.  I hope that she finds real love and success.

When I said he is clueless in the whole process I meant is the k1 process, adjusting of status & what he is going to deal with. I been there for her with the whole process from day one so I know what it took her to go through. After he abandoned her not to mention as his wife but pregnant that's when the truth came out. This was a plan from day one & his family was a part of it and played a roll with her too. And since everyone has something to say about the new he has been there for her since the day her since he abandoned her. So I think ppl need to stop judging and just answer the question that was asked

No need to be able to support the ex. They never filed for AOS. He never became a LPR. She's not responsible for him.

Normally scam artists tend to stick around until they get the 2-year GC before taking off, so they have legal status to remain the US.
