I was denied a visa last week even if it's emergency because my Mom is in critical condition in the US. It was devastating

 

The consul didn't ask for proofs and just asked me questions about my 2 siblings (LPR and a CITIZEN) who are there in the US. Didn't bother to ask about my kids and my dad who are here in the Philippines. He asked bout my work (I don't earn much because my flexible time but a regular employee for 7yrs) but didn't ask about my husband's who is the bread winner of the family.

 

He read the hospital letter after he denied me. I was crying and almost fainted. I even told him that this might be the last chance i can get to see my mom.

 

I am curious about your siblings here who applied for visa. Did they get visas? 

 

I want to re apply but emergency schedule can only be used once. it will take me almost a month for the earliest schedule :(

First and foremost, sorry to hear about the troubling times you and your family are experiencing.

 

This thread is over 10 years old and many of the posters that responded here have not been on this site for the same amount of time. This is why we try to discourage people from replying to very old threads. The likelihood of an update from them is almost nonexistent. You are free to start your own thread on the subject.

 

Unfortunately, denials for visitor visas for emergency situations do happen. There was a poster about a year or two ago who went through the same thing. her mother was on her deathbed in the US and she had doctors notes and everything but still got denied a visitor visa. Her mother eventually died without her being there. This is one of the difficult sides of immigration.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Hate to say as it is a tough situation and obviously your ar ein a hard spot right now.

The consul takes things into account; but immediately mother in the US and sibling who is a USC raises red flags for them. Philippines is tremendously tough to get a tourist visa to the US.

 

Like many others, it isnt always easy and hoping for the best but at this point all you can do is try your best to be there from afar an perhaps again try for a regular interview in the month or so when you can schedule one.

I'm sorry to hear about the circumstances.

There's not really anything you can do a this point. The CO determined that you were not eligible, likely due to 214b (immigrant intent). Unfortunately, there many others before you who have abused the visa process in the past and stayed in the US.

 

You may be able to try for humanitarian parole instead of a visa. This is basically a long shot and rarely issued, but it's something at least. I wouldn't expect a new tourist visa application to have a different result.

Very sorry to hear this.

Find this hard to believe.

Is your mom in the US legally? Do you have any derogatory visa history?

I'd have your mom or her relatives/friends contact her senator/congresswoman/man and have her/him advocate on your behalf.

Hi!

 

yes, i didn't expect it would turn out that way :(

 

My mom just visited my siblings there. She was about to come home last June 2 but has been hospitalized last May 12. She was in ICU for almost a month. She is now in a regular room but still critical. She is in a ventilator, continous dialysis, liver prob, blood probs and some other complications.

 

It was my first time to apply a visa last july 11 despite my siblings were in the US for 10 years. My family here is my priority and both of my parents live with us (husband and me) here in the Philippines.

I'm sorry but sadly this happens. About 6 months ago I heard about a woman in the Philippines who was denied a visa to go donate her kidney to her sister who was living in the United States. They were worried she was going to stay there after the surgery. 

 

I'm sorry about your mother. It is hard when our parents are very sick/pass away in another country when we can't visit them.

Luckily your mother is not alone you have 2 siblings in the US who can be with her. You should have them video chat your mother with you. Even if it's just to for her to hear your voice. 

 

It's unlikely you will get a tourist visa. What did the hospital letter say?

Sounds like you applied for a B2, and those can be applied for as many times as you want to.

Sorry you’re going through this but I don’t think you have good chances of getting a visa after a denial so soon. Your situation won’t have changed in the short amount of time between the two applications. You are a big red flag for them because your have a lot of family here. You saying you’re not going to abuse your visa and adjust status or overstay is not enough for them. Unfortunately the reality is that you’re a high risk for them. I hope your mother recovers but maybe you could have one of your siblings petition for you. It’s not gonna go fast and this wouldn’t be a visiting option but a permanent one but at least you’d be with your family.

Is she lucid enough for you to call her and talk to her? 

 

That's what I had to do when I was waiting to get my case number so I could get Emergency Advance Parole when my father was dying. I had to say my goodbyes over the phone. 

 

All you can do now is make the best out of the situation. Talk to her if you can. Support your family.
