Married within 90 days but Adjustment Of Status?

I just married my fiance three weeks ago(within the 90 days), now when does the Adjustment of status have to be done by? within 90 days?

It's advisable to adjust status within the 90 days so your fiance remains in authorized stay.

There is no specific time limit but usually, people feel a lot more comfortable with staying in authorized stay instead of out-of-status.

There is no set time frame for submission, but if the 90 days is past, and you have not submitted your AOS application , you will be out of status until you do.. once submitted you are in a period of authorised stay while they are processing the application. Being out of status does place you at risk with ICE

Like others have said, marrying within the 90 days of the I-94 is required... then technically you don't have to AOS for years (long as you do with the original petitioner); but that being said, once out of status, regardless of being married, your spouse would become eligible to be deported as they are out of legal status. It is advised to AOS as soon as you can after marriage so that way once you have the NOA1 for the I-485, you have again gained a sort of legal status that allows your spouse to remain in the US during the adjustment phase.

OP-  I agree with all the posters above.  In addition, there have been at least 2 posters within the last 6 months who said their spouses (between K-1 marriage and AOS) whose spouses were warned.....I'm not aware of any who were actually laced in removal proceeding, but it is possible......Good luck...

I see, so once it gets to the USCIS she is safe from ice? or is it when i get the Notice of Action for it?

Carry the Noa. I wouldn't be overly concerned about it, unless you live super close to a border. Just adjust and relax, but like others have said try to within 90 days if you can. I think my wife did hers on day 93 or something, wasn't a big deal at all.

Once you file, USCIS sends you a letter/notice of action with information on your file. Make sure you keep this handy.
