In the end the "alien" (or non-USC or GC holder) was able to obtain a job on EAD. Great News for all of us!

Congratulations! I am happy for you. I was reading your original thread only after it had closed, and I was getting so mad on your behalf! I am so glad that you did not listen to bad advice and walk away. This kind of casual discrimination originating from ignorance at best happens too frequently to people on here.  Taking the path of least resistance and not questioning it allows it to continue. My husband just received his EAD this week (I am the USC), and I know how anxious he is about facing this situation.You made it just that much easier for the next person to follow. It would seem they saw your persistence and due diligence as positive!

I'll just reiterate that it sounds like this was a positive result caused by proper education of what was required. When there is actual discrimination, it's a much more difficult situation to handle. In the OP's case, they just didn't know what was required but otherwise wanted him, so the persistence to inform them of his authorized work status was crucial.

I withdrew the formal complaint because DOJ cannot make a phone call with formal complaint pending. They advised me that often times this is the best way to go. They called the HR after which I received my last interview invite. It went well and I already signed an official job offer.

Thanks a lot! I was just trying to tell everyone that I was not interested in any lawsuits but rather getting an opportunity to pursue the path which I always wanted to pursue. It would have been sad if EAD got in the way especially when I can actually work and it is perfectly legal. Thanks for your support! I hope your husband find a job that he wants!
