Her I-94 is expired. We knew about the social security card process to come and we knew about being able to get one via the I-765. So we wanted to go that route to have her married name on the social security card and the EAD card and then finally the green card. But i dont know why we are getting the request for evidence since the marriage certificate gives the woman the right to use her married name as she so chooses to. Maybe its a new process with USCIS but talking to the USCIS in person yesterday they said it shouldnt matter. But i dont know if should matter or it depends on the officer assigned to our case.

Maybe it's because they don't see any evidence of her actually using her married name? Did any other pieces of evidence support a name change? Her married name on financial documents, bills etc?

Maybe it depends on the officer assigned to your case because i've seen a lot of people doing the same exact thing and had no problem whatsoever, now im  worried and wondering wether i redo all the paperwork with my maiden name to avoid any problem in the future :(

She has her married name on our car insurance. She can drive because she has a International drivers license but that will expire soon. And she has a debit card with her married name on it. However USCIS said it cant be anyhting like that as evidence but i have also heard different. I am thinking i should send in that proof as well. Since it shouldnt be too late. Or maybe they will just assign her the EAD card in her maiden name and not deny this but i doubt it. Yeah i have searched online with this particular issue and have seen maybe only three cases like this and they all seemed to go through. let me find those links

If I were you I would look up the state laws on that because most likely it has already expired in the eyes of the state. I know the card might have an expiration. But if she is considered a resident of your state it might already have expired long time ago if she has been here since at least January.
