Hi was busy before...here is more details.

 

My emergency is business travel related, and how meeting certain clients/individuals would seriously hurt my ability to do consulting work.

 

Today is more proof to me that USCIS is run by humans, I know a lot of skepticism and fear on this lately. But they just do seem rather overworked, tired humans. Then again this could be just my field office so thread with caution. First off, to make the entire process and time less tedious for everyone involved make sure you have everything ready to go. One folder should be "3rd party lett, r confirming need to travel, letter with your request to USCIS, various documents/emails/letters/records of proof", Second folder, "your i485 NOA, i765 NOA, i131 NOA, i130 NOA", Third folder, "2 passport photos, a new filled out i131 AP application, where you have chosen Emergency AP, your passport/ID".

 

USCIS does not take the entire process lightly. The lady told me the letter says you need to be there for 1 day, I said its 8 hours travel and not cheap flights so was really hoping to get 4-5 days she then understood. The "letter from third party", should match your i131 applicaiton, basically all your story needs to match.

 

So if you are going because a doctor has advised is nesscary and need to be there for say 2-3 weeks. The doctor needs to explain in the letter, tests/progress will be tracked and you need to be there for 2 weeks, if the doctor says just 1 visit or so very likely you will only be able to go for 1 week, as a caution. 

 

If you have a properly filed i485, there is no cost for emergency AP. If you have alrady done your biometrics and they are reviewed already it takes 5-10 seconds to scan your fingers. The whole process took 1 hour to 90 minutes. The document you get says I-512, AP and repeated instructions about expiry date and you best come back before said date or CBP won't accept it.

Interesting. Mine never had a date on it. They just told me it was valid for one year but that CBP would give me a hard time if I stayed longer than 6 months. 

 

I think you probably had mor scrutiny because you were "only" going to a business meeting. I think it's different when it's a medical emergency as you can't say how long, for example the dying process, will take or how long a family will mourn.

Totally agree, there is a sentence "Presentation of the orginial document prior to XX/XX/XXXX will authorize an immigration officer etc.." So maybe yours had different wording there. Again it was a very human process (no hard yes/no rules) I am sure if you have proof of the situation you describe they would act accordingly.

I don't remember what it said as CBP took it once I came back. But I do believe it had a date that was like a year into the future or something. Or worded like one year from above date or something. I don't know.

Only you know how urgent the situation really is for you to be able to travel right away.

Did you check to see if your tickets can be re-booked for a later date?

If it really was an emergency you would have had it in your hand by now. I still think you should be honest with yourself and USCIS and just re-book the ticket.

Im completely aware its not a life/death situation but I still want to get there asap and I will go ahead and try to get the emergency parole if nothing happens on the expedite request soon. I am going to be honest with everything and then its up to the agent to decide. If he/she does not grant the parole I will respect that and move the flight back etc.

However, I have not received any Emails or phone calls from them!?
