I still think you don't really have a real reason for seeking an emergency advance parole based on a medical emergency because there is no medical emergency. You just jumped the gun on buying a ticket. But on the other hand, I've seen people somehow get emergency travel permit based on the fact that they somehow came up with the brilliant idea of planning a wedding before they got their travel permit.

Whether the expedite is granted, or you have to wait for normal processing; it may be a good idea to try to change your tickets instead of outright cancelling.

USCIS officers may not bat an eye at your case, but airline customer service is easier to sway! Explain the situation and they may be able to help you out with changing the fares to a later date without too much extra charge.

I also had tickets booked before husband applied for AOS same time as you and we are still waiting on AP. The later date that I wanted had higher fares, but the airline rep changed my ticket for the fare I had already paid. I only had to pay the change fee.

From my experience at my field office last week. Granted my case is business travel related and I have formal letter the company and recruiters.

The whole "emergency travel" is up to the officer and who runs the field office to hear your case and see what they want to do. They actually majority of time do not need to see "booked flights" since they will decide what days to give to you. The same officers who do infopass will assess the case first and then take to whoever to be approved. If the doctor or whoever is saying you need to come can write a summary letter that matches your summary letter/application you have a high chance of getting it.

Your i131 is not approved right? It is irrelevant. You are applying for a new, limited access, limited time AP document.

You need passport pictures, need a new i131 application (filled out differently), need all your NOAs. Need a summary from a accredited 3rd party of the sitaution gonig on. Summary on this case would be the doctor mentioning how long the issues going on, their advice and why you are present, tests/records etc..Need your own summary with what you hope to acheive. Need accompanying evidence (pages of records, calls, updated etc).

So a new I 131 but I dont have to pay the Fee correct?

Correct it should be a part of the AOS fee, but some offices forget and ask for the fee right away. Just gently remind them.

Im glad you were able to book a new flight. What airline did you choose and did u have any sort of insurance? I will definitely ask them to do that for me too if my expedite/emergency travel parole fails.

That was with Aer Lingus, and I didn't have any insurance for those tickets. I never had a reason to get it before. Now though, paying a little extra for the cancellation option is worth it.

Good luck!

If they expedite the I-131, correct. If they do emergency AP, I believe there is the regular fee.

From what I found it should be free in emergency cases too, but would be great if someone can confirm with certainty.

Please update with how it goes.

My understanding is that emergency AP is a separate application, which is not technically linked to the pending I-485. As such, it doesn’t qualify for the fee exemption like an I-131 filed due to AOS provides. Emergency AP is usually single use with a limited date, whereas AP issued due to a pending AOS application generally is multi-use and valid for 1 year.
