Hello,

 

here is my situation. In March I have applied for AOS, in which I also applied for the I-131 travel parole. In April I completed the biometrics appointment. Back then the estimated wait time to receive the travel parole was 90 days, so I went ahead and booked a trip to my home country for early august. Now, unfortunately as some of you know, the wait time is up to 6 months and I have only 17 days left until my flight and it is unlikely that my travel parole visa will arrive in time. So I will try to expedite and/or get an emergency travel parole for humanitarian reasons.

 

To have a chance of getting said emergency travel parole I have a letter from my mothers doctor saying that she is suffering from a rare disorder and that he thinks it would medically make sense if I was there for her. The disorder is rare but not life threatening. Also I have a letter from my mom saying that she needs me there to take care of my siblings, who are still minors, until she finds a long term solution.

 

What do you guys think, will this be enough and should I mention that I got my flight booked already? Also, should I first call my congressman's office for help or should i straight up make the infopass appointment?

Good luck, but I likely think that you will find the advice given to applicants at the visa stage will apply... don't make plans until you have the document in hand,.,

I don't think this would qualify as an emergency since, as you said, it's not life-threatening.

Cancel flight and see if you can recoup a few cents. Otherwise if it was one of those non-refundable fares, then all you can do is see it go down the drain.

 

Another thing, if you need to go there to take care of siblings, that's not going to be a short trip. Are you going to abandon your AOS? You will need to attend interview, and even after you get the GC, you are still limited on how long you can stay abroad. So, I think, you have major decisions to make.

Well, hope you get the AP before early Aug.

 

Try your luck on the expedite, too, although you really do not have much of a chance on that since as you say it is not a life and death situation.

I guess you can try but make sure everything you say is a 100% truth and you don't misrepresent yourself or lie about the seriousness of the disease to increase the chances of you getting an emergency parole. I can see that being held against you in your AOS application so don't risk it all because of short-sightedness.

 

But I don't even think you should apply. You broke rule 101 in applying for visas - never make travel plans you can't change. Time to pay for your mistake.

The thing is I have heard of people who got it granted for rather minor reasons like weddings and then I read of people who didnt even get it despite a life or death situation. I guess it really depends on the officer too. Im not gonna lie about it, if I dont get it so be it, but im gonna and plead my case

Good luck. You're going to need it...breaking the golden rule is not a strong grounds for an expedite.

I have heard of cases where emergency AP was approved for seemingly frivolous reasons. However, this is very, very far from an expectation. In the meantime, people with actually critical reasons for needing to leave the US will have to wait just a bit longer.

I think you're going to have a hard sell, considering when you applied in March there was no mention of needing it expedited back then.

How would you explain that if asked at an infopass without having the agent think you're not just trying to circumvent waiting time now?
