It depends on the state, Florida Supreme Court just upheld red light cameras on May 3rd of this year. And it looks like you live in Florida, so you have to pay. Varies by state.

I only speak and give opinions based upon my own action or action which I have personally witnessed. It is the same think in New York, red loght cameras are legal and the ticket/citation will be upheld

Dear All,
Thank you so much for all of your inputs! This red-light violation happened a couple of years ago in New York, where I live. Suffolk County, NY has an infamous red-light camera program run by a private company (http://thehuntingtonian.com/2017/08/31/hector-gavilla-for-suffolk-county-says-suffolk-red-light-camera-program-steals-over-30000000-per-year-from-tax-payers/).
To be exact, my violation stated that I was in the red-light zone for 0.03 seconds!! How accurate they to a fraction of a second to pocket in money.
This happened just after I got my GC, did not want to go through any legal matters so paid it off back then. (Story would have been totally different if I was a citizen)
Couple weeks back I was eligible to apply for N400 but waited until I receive a detailed driver record from DMV. It stated that I (or my car) do not have any red-light violation even submitting the violation number I received back then. That’s why I was confused to what should I say regarding answering the question, “Have you EVER been arrested, cited, or detained by any law enforcement officer (including immigration official or any official officer of the US armed forces) for any reason?  YES  NO”.
Once again, thank you all for the inputs, I have a clear answer now.

Photo enforcement tickets such as, Red Light Cameras, Speed ticket cameras and school bus cameras  violate your due process rights. Don't reward the criminals by paying their extortion!

 

Several states ban photo enforcement citing violations of your constitutional rights. Many more court cases including one here in Texas have ruled the program is unconstitutional!

 

Class action lawsuits that will likely shut down photo enforcement are working through the court system now!

You are wrong.  If she does what you suggest, she will hurt her application.  You shouldn't double down on bad advice just because you have strong opinions about speed cameras.

Taking the question literally, it reads have you "EVER"...it's irrelevant whether it shows up on the DMV statement or not (since the question doesn't end with "that is still on record".)

 

Honestly, it's not a huge deal to disclose it---and it won't hurt your application in any way.  Not disclosing it can hurt your application if it comes to light with the IO and then he/she wonders what else you've neglected to disclose on your form.  Your choice either way, as it's your immigration journey.

 

From personal  experience, be thankful it's just a simple traffic violation in your history.  ;)  Best of luck with your filing.

Why risk anything that could possibly jeopardize your US citizenship?  It won’t count against you. However, non disclosure could quite possibly hurt you. ALWAYS be honest!  Congratulations to you!  Keep us informed of your progress. (F)

It probably should be disclosed in case it somehow shows up. BUT here's the thing about camera tickets...they are connected to the vehicle, not a person. No matter who was driving the vehicle, the camera ticket goes to the registered owner of the vehicle, not to the person actually driving. That's why it's not connected to a driving record and won't show up in a driving report. Now, if the ticket isn't paid and it goes to court, then the person accountable can be determined from the evidence. In this case it sounds like the vehicle was registered to the driver, but that's not always the case! My parents have paid many a camera ticket for violations of their children lol. No one's driving record was ever updated with this information.

I'll echo the sentiment that you might as well err on the side of caution, and disclose this.  If this is the only violation you have, and since it was under $500, there will be absolutely no impact from it for your N400 application.  If, however, you did not disclose it, and it came to light during the background investigation, and you could not explain it away to the satisfaction of the interviewer, it could be, in a worst case scenario,  considered a misrepresentation of yourself. 

 

For reference, I had two moving violations that I had gotten - one for a red light in Brooklyn, and one for a failure to move over in a road construction area.  Neither of the tickets truly held water, and the red light one was dismissed outright, though the work zone area was later converted to a equipment violation - my muffler had given out during the trip...  In any case, both were disclosed, and were promptly ignored by the interviewer when it was clear that the fine was under (I believe I was told) $600.  They did not even care to see the disposition notice on either one - which is good since the first one was so long ago that I no longer had any paperwork on it...

Seems like a trivial matter and easy enough to disclose (you already have the documentation with you). If we can disclose parking tickets, why not this? I am sure the interviewer will just move on after hearing your explanation.

Thank you all for your replies. I am filling in the N400 online. I did selected YES for having a citation (red-light traffic violation). Should I also upload documents, including the citation, payment made (bank statement) etc.? Since online application allow me to upload any additional documents I think that are necessary.
