Obtaining a marriage license without a k1 visa

Hello, I'm wondering if anybody has any experience with this. My fiance and I are planning on getting married in Ohio. We figure our best option is to get married and then apply for a cr1 visa afterwards as I have work commitments for the next 2/3 years. My question is, is there a k1 visa requirement to obtain a marriage license in Ohio? Or should photo ID and birth certificate suffice? Thank you in advance for any help.

Quick google search yielded these results: (there is no K1 visa needed to get married...however the foreigner must return to the home country afterwards, since he/she cannot stay in the US to adjust status, as there is preconceived intent)

  • Driver’s License

  • State issued ID card

  • US Military ID

  • US Passport

  • US Passport Card

  • Permanent Resident Card

  • Foreign Gov’t issued Passport

Marriage Application Requirement Ohio:

To complete the application for a marriage license, a couple must:

In order to obtain a marriage license in Ohio:

  • Both parties must be at least 18 years of age to apply for a marriage license in Ohio without parental consent.

  • Both parties must apply together in person.

    • If either or both parties are physically incapacitated, their physician must complete an affidavit stating the physical disability, and this affidavit shall be filed with the application for the marriage license.

  • Both parties must provide drivers licenses or some other valid photo identification.

  • Both parties must also know their social security number and it is preferred, but not required to have your social security card with you.

  • Both parties must complete the application.

  • Pay the necessary license fee.

You are talking about two different visas. You need to figure out which one is right for you based on your life. K1 is for single people who will travel to the states and get married and adjust status. CR1 is for people who are already married and want to move to the states. You don’t apply for both. You pick one.

Your fiance does not need a K-1 visa to marry inside the US.  In most, if not all states, the foreign fiance needs her passport and maybe a translated birth certificate.   Of course, your fiance will have to leave the US before her authorized stay has expired.

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Also - you can't apply for a CR1 and just wait for whenever it's convenient for your career. You will have to immigrate based on the immigration and processing timeline.

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

Ay. No you don’t. That doesn’t not apply to foreigners. You do not need SSN in ANY state to get married.
