Does anyone have any experience with NOT actually moving to the US after CR1 Visa is approved? 

I know it’s short notice, but we are two months away from moving and I just cannot face the US anymore and wish to stay in Germany. 

Does anyone know how this works if we want to leave in the future, say another 5-10 years?

Your visa won't be valid that long. 

 

If the visa Is already issued simply don't use it. It will expire in few months. 

If it wasn't issued yet, have the petitiner cancel the petition.

In the future you'll just have to start the process from a scratch if you decide to get a new spouse visa. No one can tell how or if the cr1 process will change. It might remain exactly the same. 

 

Letting your visa expire now should not affect the future process - they might question you about it, that's it.

1.  Let your visa expire.

2.  Start the visa process over from the beginning.......under any new rules which might be in effect at that future time.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

May not work for your specific situation but you could always enter the US, file for a re-entry permit, and leave after your biometrics. Re-entry permit lasts two years (and then you can re-apply) so you could kick the can down the road and decide then if you can face the US or not.

Re-entry permits can’t be renewed beyond a maximum of 5 years though. And in the meantime OP will have to comply with certain facets of being a green card holder such as filing tax returns with the IRS every year.  So it may be a solution, but a better one for a shorter planned absence - if they are looking at more like 10 than 5 years it’s probably better to let the visa lapse and reapply in the (distant) future.

Yup. My idea was sort of a middle ground of kicking the can down the road 2-4 years before they make a decision. Not a long-term solution.

Thank you, everyone. It’s a tough decision to make and one I didn’t realize was eating away at me for so long.

My 2 cents - visas cost an arm, a leg and your first born! <------ (A joke.....don't get it confused) :)

 

I won't delve into the personal reason(s) behind your decision to not follow through with coming to the US after the CR1 was approved and you are just delaying your POE. What I will say is this: the decision is yours and whatever you come to is one you will have to live with.

I think it takes a lot of courage to make a decision like that when you’re well on the way and everything is rolling. (It sounds similar to someone I know who regretted their wedding but everything had been planned etc and they felt they had to go along with it....) most people here know emigration is not easy and what works for some doesn’t work for others. We’ve never regretted moving and I know others like us, but I also know people who after years in the US have still never felt like it’s “home”, and not for lack of trying. Good luck to the OP and I’m sure VJ will still be here if you do decide to go after all some years down the line :)

No such a thing as a "modified Visa application".  You will have to start ALL OVER AGAIN.  No question.
