Hi,

 

Could somebody quickly double check if I thought about everything for the AOS? How you organized them? Separately bound them together and put it in the same envelope? Do I need something else? Did I miss anything?

WORK PERMIT (I-765):
1. G-1145 Form for E-Notification of Application/Petition Acceptance
2. Form I-765, Application for Employment Authorization, signed & dated
3. Copy of biographic page of passport
4. Copy of K1 visa page
5. Copy of my Form I-94, Arrival-Departure Record
6. Photocopy of our marriage license
7. 2 passport photos (with my full name and Alien # at the back)
8. EAD cover letter


TRAVEL DOCUMENT (I-131):
1. G-1145 Form for E-Notification
2. Form I-131, Application for Travel Document
3. Copy of biographic page of passport
4. Copy of K1 visa page
5. Copy of my Form I-94, Arrival-Departure Record
6. Photocopy of our marriage license
7. 2 passport photos (with my full name and Alien # at the back)
8. AP cover letter


AOS (I-485):
1. G-1145 Form for E-Notification
2. $1225 check or money order
3. I-485 Application to Register Permanent Residence or Adjust Status
4. Copy of my Birth Certificate
5. Copy of K1-visa in passport and USA entry stamp
6. 2 passport photos (with my full name and Alien # at the back)
7. I-693 Medical in sealed evelope
8. I-864 Affidavit of Support and Tax returns
10. Proof of US Citizenship of my husband – his Copy of Passport
11. Copy of I-797 – Notice of Action, Approval of K1 Petition
12. Original Certified copy of Marriage License
13. Copy of I-94 – Arrival/Departure Record
14. Photocopy of Passport Biographical Details Page (all passport too)
15. AOS cover letter

No. I don't have my name on any utility bills or lease.... Maybe down the line it will be added before the interview.... Or joint bank account, but still until I am not able to work a joint bank account would prove anything?

Timeline

A couple things I caught. Note, I didn't do an AOS from a K-1 visa though, so not sure what additional documents are needed there.

  • Assuming you are also submitting I-130? If not, you need as supporting documents which you did not include in your list
    • Husbands' birth certificate
    • Husband's tax returns (at least one year, up to three years) and ideally last 6 months of pay stubs for his I-864
    • Evidence of bona fide marriage (e.g., photos, joint bank accounts, joint lease, etc.)
  • You only need one G-1145, attached to the I-130
  • Do you have any past EAD cards? If so, need front and back photocopies of all
  • Don't need marriage license with I-131
  • Include translation of birth certificate if not in English (seeing you're from Romania)

 

05/16/18: Married to USC

05/24/18: Mailed in AOS package

05/25/18: Priority date

06/07/18: Received NOA in mail

06/09/18: Received Biometrics appointment in mail

06/19/18: Completed Biometrics; submitted request to expedite EAD based on Severe Financial Loss (pending job offer and end of then-current employment)

06/20/18: Submitted case to Congresswoman's office, which submitted an expedite request on their end

06/22/18: Faxed supporting documents per email response from USCIS; submitted case to Ombudsman

06/26/18: Received email response from USCIS that my case is under review

06/29/18: End of then-current employment

07/06/18: EAD approved, and card in production

07/13/18: Received combo card in mail

03/01/19: Received request for initial interview notice

04/09/19: Initial interview; AOS approved

They ask for all this stuff, but I just came back from my interview and they didn't ask for anything, but some joint assets. The lady understood that since I am not working yet, I can't be on everything, but we had joint bank, credit card, health insurance and car insurance. That is all she took, didn't even look at anything else we took with us.

 

Not sure if it is just up to the interviewer or not ... ?

PD for AOS ? ... just looked at it and it doesn't show anything, just has received date of January 30, 2018. The lady said she sees no reason not to approve, however, I am yet to receive confirmation of that. We just had a chat about the application form, she asked for any joint liabilities/assets we might have, made a few notes on them and put them in my file and that was it. didn't look at our birth certificates, marriage certificate or anything else.

Thank you. Will remove all the extra docs.

 

I've put the tax returns with the Affidavit of support. 3 years

We used full copy of passport instead of birth certificate. It worked for the K1.....

About evidence... Hope we don't get any RFE.... But for now the marriage is kinda new, by the time of the interview we will have more evidence  (naturally) of bona fide marriage....

No previous EAD cards...

My birth certificate has Romanian, French and English on it, so no translation, I hope it will be ok without an extra translation

While adjusting from a K-1, is the I-130 required? It's not mentioned in the guide. Does one need to attach documents like the marriage certificate, I-94 etc to each form or just one copy in the entire package?

I-130 is not required since you are on a K-1 visa. You had the I-129F instead of I-130.

I made 3 separate "packages" for each form and it's supporting documents and sent them all in together, so yeah there are stuff which are duplicate for each form....

How many forms you are sending in?

Each form asks for two identical pictures.

If you are filing for I-485, I-131 and I-765 then you will need total of SIX (6) passport style photographs.
