infamous RFE that i will be getting in the mail

hello!

 

so, update on my case, I have submitted my AOS package from an H2A visa for my husband last May 2018. PD is 5-11-2018. 

 

His biometrics was June 15, 2018.

 

Yesterday, I just got a notification that an RFE is sent out.

 

I know for sure I had everything they had asked for EXCEPT the medical that he needs to do.

 

SO, since we were just 2 months into this, could it already be the medical? 

 

Any guesses what it could be? 

 

Waiting for the notice, waiting for anything, is sooooo nerve wracking.

 

other than that, we haven't heard anything for his AP/EAD. hopefully we get those soon..

If everything they asked was there EXCEPT medical, I would say that my guess your RFE is for Medical  ...that was easy

but isn't medical asked during the interview since it only lasts for 1 year? 

 

That would be awesome if we are getting the GC in a year but looking at USCIS processing times, 16.5 months.

Yes and no. Your RFE could also be about something else....We`ll know once you receive it.

Form I-485 applicants for adjustment of status are required to have a medical examination to show that they are free from health conditions that would make them inadmissible. Only a USCIS designated civil surgeon can perform this medical examination in the United States. The civil surgeon must document the results of your medical examination on Form I-693. For more information on the medical examination, see the Form I-693 Instructions. 

You are NOT required to submit Form I-693 at the time you file your adjustment application, but may do so if you wish. My bet is an issue with the I-864. That's about the right timeline for an RFIE due to it. But it could be something else (missing/lost/invalid marriage certificate, missing/lost other required forms, etc.).

Most RFE are for birth certificates authenticity and/or their translation,  affidavit of support or marriage certificate. 

You will not be issued a RFE for medical they will send you a courtesy letter letting you know to get it ready for the interview or mail when prompted.

UPDATE:

 

It was an RFE for his birth certificate, what we submitted with the application was his "adoption papers" (it's called acta de reconocimiento de hijos in Mexico) i guess. He told me it was like a birth certificate and it was the same thing he used to get his Visa. So, I didn't question him but since the RFE is about his birth certificate, that's how it clicked that I shouldn't have listened to him and I should have submitted both to be safe..

 

But we will submit the birth certificate as soon as we get the translation online.

Just one quick question, 

 

Will 1 letter, JALAPA and XALAPA matter? His BC says JAPALA but the city name was changed to XALAPA.
