K3 in U.S. applying for AOS - I-130 approval today

Timeline

Hello again,

I-130 approval letter came in today.

Q1: Do I now have a choice between consular processing or AOS'ing here ?

Q2: If I choose to AOS, is there a specific procedure to be followed to inform the USCIS and the Montreal consulate of my choice?

18-Aug-06 Filed I-129F

19-Oct-06 I-129F Approved

10-Apr-07 K3 Visa Received from Montreal

17-Apr-07 Entered U.S. on K3 (Toronto Airport Preclearance)

04-May-07 I-130 Approved

Lately USCIS will hold the approved I-130 because of the K-3, the I-130 wont get sent to the NVC unless you file I-824 and pay $200, requesting it to be sent.

You probably are further ahead doing the AOS at this point.

You dont need to contact NVC or the consulate.

Does anyone know what happens if you started NVC processing with the I-130 and then never finished because you decided to go with the K-3 visa? My husband arrived a few days ago on a K-3 visa and now we're preparing the AOS documents.

I have a friend who did the K-3, they just abandoned the I-130 after getting the K-3 visa, and did the AOS through USCIS.

12/11/2006 - Welcome Letter and GREEN CARD in Mail!!!!!! Lets' party!!!!!
09/24/2008 - sent Removal of conditions package to VSC
07/02/2009 - received 10 year Green Card! YEAH!!!!! Finally!
2014 - Citizenship
