18y difference between us, will it be considered as difficult case?

Hi

Me and my fiancé have 18y difference (28 and 46), will this be considered as a difficult case? None of us have been previously married, we don't have any charges/convictions, never changed our names etc...

We have the I-129F pack ready to send, do you think we gonna be ok without a lawyer?

I think it is going to be ok as long as your relationship is legit. Love has no age, race or ethnic. If you have payed attention to all the details on K1 requests, you dont need a lawyer. 

 

Collect proof of your relationship, ask questions, read VJ posts and you will be fine. Good luck

11/30/2017 - EAD/AP Approved
12/01/2017 - Card in Production
12/05/2017 - Received Approval Notice in the Mail
12/06//2017 - Card Mailed (Priority Mail) to Me
12/07/2017 - Card Received 

1/19/18  --- Interview Date 2/21

2/21/18  ---  Approved on the Spot

  • 1 hour after the interview received uscis mobile app alert
  • Status changed from "Interview is scheduled" to "New Card Is Being Produced

2/26/18  --- Received hard copy of NOA for the Green Card

2/26/18  --- USCIS Mobile Status changed to "Card was mailed to me"

2/28/18 --- Permanent Resident/Green Card received :jest:

" Have you tried the search tool? K1 isnt an easy process and a LOT of reading is required to avoid problems (RFEs) etc, if you dont like reading, be prepared to spend WAY more time and couple more $$$ with an lawyer "

There are many factors in which Consulate Officers will use to make a decision. Age difference can not be used a the sole reason for denial, but it will be among all the factors.  How much actual face to face time have you spent together is a big one. Same religion, etc...

 

You should submit quality evidence,,,,,

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

We have met 7 times in 13 months, he came in London twice, and I have been in US 5 times (each visit was a week typically, but on my second visit I spent 1 month there), I have attached all the boarding passes of our separate trips to see each other and boarding passes of trips together, about 30 photos, engagement ring receipt, screenshots of chats and FaceTime, facebook tags together, copy of 3 cards he sent me, a copy of a card one of our friend send us and email of airlines for our next holiday in September.

If you have strong evidence to provide and your relationship is in bona fide, the age gap between the two of you has no legal grounds for a denial. 


Despite it being one of the biggest red flags for USCIS and consuls, you seem to have strong ties with your fiancé and it looks like you provided good evidence in your I-129F. If you feel there are other "no commonality" concerns between you (for instance, cultural or religious differences, no shared language, etc) I would recommend the assistance of a lawyer. 
With all things being considered, also keep in mind that each case is uniquely treated, according to many factors that are not just limited to the "no commonality" concern. Moreover, Italy is not listed as a high fraud country by USCIS. 

You will most definitely be asked about your age difference during your interview, but as long as you are transparent about your case, you don't have to worry.

My husband is of Indian heritage, born and raised in the United States, and fairly distant from the traditional Indian culture. However, during my interview I was grilled about this alleged cultural difference between us.
Unfortunately there are people who get away with it, and those people are the reason why the process takes so long and consuls are legitimately suspicious about any potential red flag.

It could be used as a factor but it’s never the sole reason for any denial. For example, several posters here have 18+ age differeces with approval and had no issues with their K1 journey.

 

 As long as your package is solid you should be good to go

What is a lawyer going to do for you?

 

18 years difference is usually no big deal and actually quite common for some countries.

Just when you think you have TDS eradicate,  a new case shows up.

It sounds like you have a lot of significant evidence, and Italy is not a high-fraud country. The age difference should not hold much weight, given all the rest. Just make sure to dot your i's and cross your t's, and you will be fine. :)

My husband is 16 years older than I am, and we have had no problems. Just continue to take pictures of everything you do together. Log your road trips and hotels you stay at. Take a lot of selfies if no one can take it for you. Inside the hotel room and the places you visit. Try to get a name in the background of the picture to show the place you are visiting. Above all, honesty in all you do is the key here, they want to see that you have a marriage of faith. The best of luck to you.

I think given where you’re from this won’t be an issue. Don’t waste your money on a lawyer. If there’s a bump on the road you deal with it when it comes.
