Timeline

I have a question on form I129F part 3 on multiple filer waiver request information.  I'm not sure what to answer.  Do I need to request a waiver since this is my second K1?

As far as I'm aware it's for people on their 3rd petition, or within a certain time frame. When was the first petition?  DId they enter the US and adjust status or?

 

It does ask for that information I believe on the form also.

08/15/2014 : Met Online

06/30/2016 : I-129F Packet Sent

11/08/2016 : Interview - APPROVED!

11/23/2016 : POE - Dallas, Texas

From sending of I-129F petiton to POE - 146 days.

 

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

How long ago? If within two years, I believe anyways, not 100% sure, then you ask for a waiver for short filing times.. If over 2 years since then probably don't need one. Again this isn't my expert area so hopefully someone else can give you the full scoop on it. Also remember the I-129f form I believe again asks about previous filing information (case numbers, ect) and you have to claim your ex on your I-134 and I-864 again since you probably I assume are on the hook for them still if they only have a conditional GC.

You need the waiver if you've had more than one petition filed in the last 2 years, or more than 2 overall.

06/12/18 left NVC

06/13/18 Manila Embassy received

06/13/18 CFO completed at Clark Pampanga

07/10/18 Interview - APPROVED!!

Let me understand this correctly.  If my first petition was approved more than 2 years ago.  Then I don't need a waiver?

My first I-129F was approved in January 2016.  So, if this is the case it would be more than two years.  Is that mean I don't need a waiver?

Think you should be fine to file without a waiver yes.
