I am filling out the i-864 for my wife's COS. Theirs a question asking how much my current yearly income is. The thing is I started a new job in January so I dont know how much my yearly income  will be this year. Also, the pay is dependent on how much overtime i work. So any clue what I should put? 

Also should we send just the most recent years tax return 2017 or the past 3 years? We have a joint sponsor who is sending three years of tax returns.

You put your base salary , do not include the overtime because you may not work the same amount of overtime every week or worse, overtime may not be available.

 

when calculating potential yearly income always go for your base salary, do not include, overtime, tips or other gratuity

Agreed with the response above. Put your base salary so that it can be backed up by your pay stubs (which you should include, though optional I think) to minimize risk of RFE asking to prove the higher salary.

AOS* (COS is for non-immigrant to non-immigrant status changes)

 

Your yearly income is how much you earn in a year's time, not how much you earn in a calendar year (Jan 1-Dec 31).

I would personally put down how much you earn in a typical week * 52 weeks. Only if overtime is necessary to meet the requirements would I list it...the IO may or may not consider it unless you can document it pretty well.

It's not as simple as just multiplying my wage by 40hrs a week. We work 10 hour days 6 days a week. I work 60 hrs a week, but  get paid for 70 hrs. Even if I work 4 days at 10 hrs, I would be paid for 44 hours.

Unless doing so will result in an income level below the "poverty" line, you can follow the below:

  • Do you have a fixed annual base salary in your original employment contract? If so, you should put that.
  • Otherwise, does your original employment contract include hourly wage and minimum hours worked per week? If so, do the multiplication based on those numbers.
  • Otherwise, since you have been on the job for 6 months already, multiple everything you have previously earned by two; this effectively averages your weekly salary and annualizes it. Then include all paystubs from those last six months.

If the above results in an income level below the "poverty" line, include any overtime / bonuses / etc. to get as close to the threshold as reasonably justifiable, or look to add a co-sponsor.
