My fiance had his interview in Morocco on June 28th and they told him no and said it was due to 221g. Anyone else have these issues? We aren't sure why and what caused the suspicion as they do not tell you. I was finally able to make an appointment in a few weeks at my local immigration office, but wondering if others have gone through this and the timeline. I am very discouraged as we have been waiting 8 months and are living apart. We thought it best I stay working and maintaining a home in the united states. Needing some encouragement.

Did they say he was missing anything at the interview? Or did he get a piece of paper that says 'refused'?

He said they didn't tell him anything, just no. They didn't ask for more documentation and we haven't received notification from the USCIS. The letter just said Returned to USCIS under section 221(g) and for me to contact my local USCIS office. He said they asked him a lot about his travel to Turkey and Saudi Arabia so I'm thinking there was some suspicion there.

What will likely happen now is that the case will be returned to USCIS and it will expire. Is the travel to Turkey and Saudia Arabia the only red flag in your case? Do you have any other red flags like a large age difference or several previous marriages? Was there a timeline that didn't quite add up perhaps?

 

You'll want to try to ask your fiance what he thinks the reason for the refusal is. Your next step is getting married in Morocco and filing a CR1 visa. K1 refusals are common in Morocco, unfortunately.

It will be returned to USCIS, and it will expire.  There will be no appeal.......sounds like the CO has doubts about the relationship.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I agree that travel history wouldn't cause a denial......maybe extended administrative processing..........usually, there is more to the story than even the US citizen knows.......

OP-  It would be of benefit to now exactly what was said during the interview.......

You always leave the interview knowing why you were denied. Ask your fiancé because he should know and maybe just didn’t tell you. They always tell you why you are refused. Unfortunately because this is a K1 you cannot appeal. The case is sent back to USCIS to expire. If you know the reason why you were refused and it’s not due to something that makes him ineligible for a visa, don’t waste your time waiting for USCIS. Go over there and get married. Then withdraw your K1 petition and apply for CR1. It will take a while and some more money. It will also require several visits. Good luck.

I agree that your options are now limited to:

1.  Find the reason for the denial, front load a new K-1 with quality evidence (a lot actual time together is strong evidence), and refile.

2.  Vist a few more times there, marry, front load a CR-1, and file.

 

Morocco is a difficult consulate.  It will require a great deal of planning, patience, and money....There are others here on VJ who have successfully recovered after a denial.

Casablanca can certainly be a bit unclear when it comes to visa refusals. However, generally the couple has somewhat of an idea as to why they were refused. Traveling to Turkey and KSA isn't that uncommon for Moroccans. 

 

The most common reason for denials in Casablanca is because the CO does not believe the relationship is entirely genuine. An unfortunate history of visa fraud coming from Morocco has given the CO a stricter mindset when it comes to visa approvals. Cases where there is a large age difference (10+ years), especially when it is a older female petitioner, are heavily questioned. Cases were the petitioner or beneficiary have had multiple previous marriages, or very recent divorces raise suspicion as well. It is also important for the beneficiary to demonstrate that they can speak English well (or prove they can communicate effectively with the petitioner in another language).

The key to a successful visa approval in Morocco is spending a lot of time in person together. The more trips to you make to see him, the better. I realize that this is expensive and takes a lot of time, time and money that many people do not have. If you want a successful visa journey, you will need to put in the time and money. Some may say that is it unfair that Casablanca is such a tough consulate, but it is what it is.

no, we never receive a reason why they deny

i have asked for the reason since my K1 2009 interview

 

now, to your case

most K1's in Morocco are denied as it is  a high fraud country   / Saudi is not

He will lnow why, ask him how the interview went, agree as far as mobing to the US is concerned look at the CR1 route.

Is the petition being sent back to USCIS for revocation? If so, then yes, it will sit to expire upon return. You will need to either refile or (preferably) marry and then file an I-130 for a CR-1 visa. Figuring out why they felt the I-129F was invalid (likely that they didn't believe the relationship was bona fide) is important for any new petition.

No big age differences and no other red flags; we both have never been married and neither of us have children. The only thing then maybe is the length of our relationship. I've visited Morocco twice but I thought it was more important for me to have enough money to support him here in the US then traveling to Morocco. I gladly would have gone more then. It's so hard to know- I was trying to save for our future. They didn't even ask to look at the documentation for our relationship either so not sure. So frustrating. I'm fine getting married in Morocco, just wasn't my first choice. Thanks for all your help.
