Any thoughts on how to file 2005 Income Taxes with a December wedding date? Married Joint, Married Filing Sep, HH, Single? I am confused because Liz was not a permanent resident yet but we are married...so how does that work?

You were married in December, so you will file married. Joint or Separate will depend on which makes most sense for you -- probably joint.

You can elect to treat her as a resident for tax purposes by sending a statement to that effect to the IRS signed by both of you.

If she had income you will most likely qualify to exclude all of that income (up to $80,000) as long as she resided in her home country for 330 days prior to coming here (doesn't have to be all in 2005).

We, like you were married in December of 2005 with our AOS paperwork not filed until January 2006 and will be filing jointly. My husband has chatted with the IRS a few times now to make sure we do things correctly.

We were married in December 2004 and had no problem filing as married and claiming the tax benefit in January 2005...
