Hi Everyone:

Following up on the Montreal consulate's officer saying that the authorization stamp can and should be issued at any POE, Jonathon called Pearson and spoke with US Customs and Border Patrol. They told him a couple of things that perplexed me and I'm hoping someone can help me clarify it:

1. Toronto doesn't issue a temporary stamp -- in fact, she said no Canadian POE issues ANY temporary work authorization stamp -- by land or air.

2. He cannot, under any circumstances, work in the United States until the I-175 is processed AND he receives authorization. This takes a minimum of 60 days.

Jon has a great opportunity at a big company here in Silicon Valley and while they will take the chance with the 90 day authorization, they certainly won't wait 90 days.

Does anyone know who I might call government-wise for clarification of the rules. It seems that Montreal is way out of touch with USCBP.

Phone Call Two: April 13, 2007: No Date: She said that while no date is scheduled, they're moving toward our date of January 17th and that late May seems likely for an interview.

Phone Call Three: April 17, 2007 -- No Date: Our interview should be within the 6-8 week timeframe.

Letter from Congressional Representative: We have a backlog of up to six months for appointments. It is doubtful we will be able to accommodate him before June.

Phone Call Four: Montreal gives Jon an interview date of May 9th -- that's next week. And supposedly Packet 4 is in the mail.

The only POE that I have heard of that stamps the passport with temp EAD is JFK airport.

Maybe years ago each POE gave out the EAD stamp, but that is not the case now. If one is FLYING from Canada to the USA, none of the airports hand out the EAD! At 1 time Halifax didnt have USA immigration there, so u could fly from halifax to JFK, and get the EAD at JFK, no longer the case!!!

I belive soem one recently stated they got an EAD at 1 of the Ontario crossings!! There is a list on here where some one (just recently too) phoned each of the Border crossings and asked if they handed out the EAD. Its somewhere in the canada section

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

You can get it if you drive across the Windsor/Detroit Ambassador Bridge. Call to ensure that this is still the case, but I got it there this year.

May 6 - Received an email response saying things were progressing normally but that waiting times might be longer

Mar 17 - got email, attached to one case number only, saying that my A number was changed relating to the I-130 filing

Ive occasionally wondered if you , after calling and getting confirmation that a stamp will be issued , could schedule an appointment with the person you spoke with to have them aide in or actually be the one to proccess you when you cross......?

any thoughts?
