Recommended Posts

The problem is, there seems to be so many differing opinions and experiences. It really is a lottery. Just a simple search on Google reveals that there doesn't seem to be a definitive answer. I've read through many pages on this topic and others on VJ and haven't seen one post from somebody who was denied.

However, that chance, no matter how small, that I could be turned away and the implications that come with it....from being so close to the finish line. Is it worth the risk?

The chances of you being denied are small. In the unlikely event you were, it would have no bearing on the visa process.

So the posts I've read claiming that denial of entry = a 5 year ban are untrue? That's a huge relief! I thought it seemed a bit OTT, even for US border control

Huh? Where did you read that? No, there is no ban if they deny you entry on an ESTA. You will not be able to use ESTA for quite a while, but that is the only consequence.

From what I've read this is not advisable, the likelihood of being barred entry is quite high post NOA2 and it's best to wait until the visa is in hand to make the trip.

N.B. this is only from what I've read, I'm no expert or anything.

Why would it be higher? When you already got your NOA2, you're so damn close and it would be really stupid to mess it up by overstaying or trying to stay.

I don't think it makes any difference where you are in the process.

In the end it all depends on the officer and if he has a good day or not :)

I agree with this. Common sense would dictate that you're more likely to overstay or get married during your trip early in the k1 process (when you realise how long the wait at TSC is going to be) rather than late in the process when you are almost there. Also the fact that you've made previous trips and haven't overstayed or got married makes it less likely that you will this time.

I actually travelled after my NOA2 (it came about two weeks before my trip), I knew it would still be a month or so until it went via NVC to London. I called up and arranged my medical from the US for when I returned. In the event the issue didn't even come up at immigration... he asked how long I was staying (3 weeks), where I would be staying (Wilmington NC), what I would be doing (sitting on a beach and going out to bars) and didn't ask who I was staying with (my fiancee) so I didn't mention it.

So if he asked why I wouldn't overstay the answer was obvious - I'm going to have to return home to complete my k1 visa process in the next month. I'd be utterly nuts to overstay or get married during that trip.

The worst that can happen is that you're denied entry, but I think that unlikely, and it won't affect your k1 UNLESS you've lied to the immigration officers. So don't. I said to my fiancee that I'd rather be denied entry for being honest about visiting her, than be denied for lying about it. If I'm denied for being honest it won't affect my k1 and I'll see her soon enough, would just need a bit of patience.

What about NOA2? I've looked at the last 20 pages of this thread, and a lot of people mention that they have their NOA1 but not much about post-NOA2.

I'm planning of visiting my U.S fiancee from June 26th - July 20th. (I'm having my medical on June 10th, but not planning on scheduling interview until I return to the U.K) The last time I was in the US was February (before we filed for the K-1)

Is this advisable or not? (I've already paid for the flights!)

Go through Pheebs1201 ´s posts and look for their experience traveling post NOA2 (they were fine). They are US/UK and got their visa a few months ago. I see you are from the UK as well, so while no two cases are exactly the same, it is easier to compare notes with someone from a similar country :-)

You will be just fine. My Fiancé is currently visiting me for 3 1/2 months and he didn't even have a return ticket! this isn't recommended though, but he had the following to prove his sincerity:

1. Letters regarding our K1 visa approval for me to travel to the US

2. My letter of invitation, plus my letter of employment

3. A letter from his university about his Masters programme

4. Evidence of him owning a property in the US

Just thought I'd share, to give other the reassurance :thumbs:

Timeline

We just filed our I-129 form and it just arrived to Dallas lockbox. I wonder if I would be possible to visit my fiance in America who is an USC from September 1st till the end of December?We want to spend our birthdays together and also Christmas together if that is possible. I am not so sure whether the immigration officer at the custom would let me in since I will be having a pending K1 application by then and certainly 4 months is a long time of stay.

I would be able to bring along:

1)A letter from my employer saying that I will be expected to come back and resume work in January 2016;

2)A copy of I-129 form

3)My return ticket

I dont know what else I need to prepare to show the ties to my home country and I will return to finish all the visa application (Med check and also the interview).

Do you think I would be allowed in with just above documents for like about 4 months stay there? Please help me!! Thanks a lot !!

I have a B2 travel visa which for HK passport, I should be able to get admitted for 6 months time.

Timeline

I'm planning on visiting my fiancé for 3 1/3 months from Sept to mid-Dec because of the delays at TSC. I have a B2 visa. We are currently together in Canada until September, and will likely to get our NOA-2 in late September or October. If I return to the UK after Canada we will a month or so onto our time apart, so have decided to delay the UK part until Dec and visit in the meantime. I visited for 5 months from October to March and then had a few days in mid-April (on my way home to the UK from Costa Rica) and had a chat with the officer at the border specifically about her opinion of when I could return to the US. She said that if my K1 visa wasn't ready by August then I could visit for up to 6 months from then. She admitted me for 6 months even though I needed a few days and she knew we had a K1 in process at the time. She made sure I knew that I couldn't marry during that stay or any other before entry on the K1, and I of course said that I would not.

I am a bit nervous about another long (3 1/2 month) visit to the US after a previous 5 month stay, however I also feel confident that by being honest and knowledgable about the K1 process that I shouldn't have problems. Like lots of others have already said, it would be complete madness to overstay, and also if I were going to marry him and adjust status in the US, then I would have done so on my previous visit. It is something we've considered, but think it's too risky so are going to complete the process properly.

What do you all think about a long visit? It's within the time allowed on my B2 visa (6 months) and I have spent 5 months out of the US since my 5 month visit, but still... hopefully I will get an understanding IO
