Of course, as the process continued, my ties to the UK got more and more tenuous!

I think this is a big challenge with proving ties right near the end when you are trying to finalize things.

Gary is unemployed right now, since October actually, because he was here over the holidays and we wanted to be prepared for the visa. He is living at his parents as well, so no home ties. BUT! They didn't ask for his letters or anything. He stated that he was coming to visit me, and that he had an interview scheduled and would be going back for that. A HELL of a lot easier than his first entry, which was horrendous and terrifying.

So pleased for you!

I want to visit my fiance on VWP (I already have been approved an ESTA) while undergoing the K1 visa application process because it is going to take forever and we can't bear being apart for that long (he's paying for the trip). The problem is that on other topics people are saying you have to take proof of ties to demonstrate your intend to go back and that people regularly get asked for that kind of proof. Problem is... I do not have any ties.

I don't have a job, I don't pay rent/have no rent agreements, nor have any savings, loans, money, nor do I study (staying with a couple of friends). I have literally nothing keeping me here. I do not have any intention of breaking the VWP or not following the visa procedure but how on earth am I going to be able to visit my fiance without proof that I'm not intending to stay? Any suggestions? I just feel like I'm going to be denied and treated like a criminal even though I have the best of intentions :/ I wouldn't risk my K1 visa so why wouldn't I return?

2013 - Met online
2014 - First met in real life
2015 - First time living together for extended periods of time.
2016 Early May - Got married
2016 Mid May - Send off AOS application (Waiting for response)

Hey, just spent an hour reading posts here. Glad I found it. So, I'm a Canadian citizen. If were to attempt to visit my fiance, I know proof of ties are required. The only ties I would have is that I'm enrolled in University. We would be travelling by car, probably Sarnia border. I live with my parents and dont pay bills. I suppose my only proof would be a letter of proof of enrollment from my school. Would it just be a waste of a drive to even try? My fiance would pick me up and wed go to the US together. If I attempted to cross and get denied, would I have problems the next times I try to get into the US?

I just arrived from US on Feb 25. I flew to Atlanta and it was so deeply easy. I told the truth, "visiting my fiance" and the officer, a woman, got positively surprised. She asked me the usual questions and everything was ok. I brought a letter from my work and a statement from my son's school that I pay its monthly payment. I didn't need none of them. Good luck for everyone! ;)

Hey guys,

First of all, this thread is really helpful. I was sure it wasn't possible to visit my fiancé during K1 process, but after reading the posts here I have renewed hope.

So here's the thing. I am Brazilian and I have a tourist visa that's good until 2022. I have visited my fiancé twice in the last 2 years, January 2014 - February 2014 (1 month) and then again December 2014 - February 2015 (2 months, although the stamp stated I was good to stay until May). Both times I had no issues at all with immigration (my POE is Miami). We are currently waiting for our NOA2, and as a February filer I have no hopes of getting it before mid-September (TSC). I will be graduating in July and would be free to go visit him and continue the wait for the NOA2 together.

If I tried to go, I would definitely take the return ticket with me and a letter from my employer. I live with my parents, so no rent, mortgage, etc.

Do you guys think it would be hard trying to get in for about 2 months this July? My fear is, I just came back from another 2-month stay this February.

The two times I went there, I did not mention I had a fiancé (or boyfriend, on the first time), but I did not lie. He simply didn't ask.

Meanwhile, my love will be visiting me here in Brazil for 10 days arriving this Friday (thanks to spring break), so we will be able to enjoy some more time together.

I appreciate your opinion, guys!

Hi,

Hopefully a nice and simple question. My fiancé and I have just started a K1 application. We have just received NOA1. I am booked to fly out to the states in April (aware of the risks), however, we plan to drive into Canada for one day during my trip. Will I have any trouble going into Canada or coming back into the states? Surely once Im in the States im ok and I can travel freely as long as I return when I say I will?

Thanks
Levy

Travel.state.gov says this:

Trips to Canada, Mexico, or nearby Islands

If you are admitted to the United States under the VWP, you may take a short trip to Canada, Mexico, or a nearby island and generally be readmitted to the United States under the VWP for the remainder of the original 90 days granted upon your initial arrival in the United States. Therefore, the length of time of your total stay, including the short trip, must be 90 days or less. See the Customs and Border Protection (CBP) website.

Citizens of VWP countries* who reside in Mexico, Canada, or a nearby island are generally exempted from the requirement to show onward travel to another country* when entering the United States. Learn more at the CBP website.

So yes, you're fine.

Arrived here on February 27. This is the second time arriving on Visa Waiver and first time I used the kiosk which was very easy, just had to give my receipt to the Immigration officer.

As usual I am honest and tell them I am visiting my fiance and as usual they asked if I was excited and never once ask if we're planning on getting married or wants to see any proof I am planning on returning to Sweden. Only thing they ask is if I am here to use my student visa or if I am here on ESTA since I still have a student visa.

Thanks. My lawyer made it sound a lot worse than it appears to be. I intend to just be honest, bring some proof of my intended return to London and hope for the best.
