Hi all, my fiancee is visiting me from Colombia next Monday (the 17th) and she is staying until June 4th. Is there any problem with the lenght of the stay? This is more than 2 months. Btw, we alredy fiiled for the K1 visa and received NOA1. POE will be Fort Lauderdale, FL, she has a tourist visa.

Thanks for the help smile.png

How was her experience coming into her POE? Did she have documents linking her to her home country? Did she need them?

Hi all, this is my situation: I am an italian citizen andI got denied a j1 visa in the past and because of that my ESTA got denied too. We filed the I-129 f in january and I would like to go visit my fiancee in the US while the k1 is pending. The problem is that I cant go to the US under the ESTA but I will have to apply for a tourist visa. Having a pending I-129F and prior ESTA and visa refusals, do you think I should try to schedule an interview at the embassy or should I just drop it and wait?

Hey guys,

just to let everyone know that i came to new york JFK on the 24th of march and im staying until the 24th of may 2014. I came over using my ESTA and i brought a letter from my employer, my university and recent pay slips but when i arrived i was only asked why i was visiting.... to visit my fiance. what do i do for work..... data analyst. he then asked what does that job entail.... i gave a few details he then stamped my form and asked for my finger prints. i didnt have to show any proof of anything but i would suggest having it just in case.

I am a Canadian with an American fiancé. I crossed the border in March, after filing in February and had no problem! They didn't ask anything out of the ordinary. I kept my answers short and honest. :D

Your fiancé will be fine!

Out of curiosity, when you are crossing the border, does the border agent know you have filed by pulling up your passport info?

Last time I crossed the border, I was expecting lots of K1 related questions, but got none. I didn't volunteer the fact that I had a K1 in progress and they didn't bring it up.

I'm crossing again this weekend, so we will see how it goes.

My fiance has visited 3 times since NOA1 and she has never been asked about the K1. She has always volunteered that she is visiting her fiance and one time did tell the agent we were in the process of securing a visa but was not questioned further. Basically they asked her general questions about her classes (she's a student) and about me, where I lived and where I worked, etc.

She has always had some proof of ties documents with her but has never been asked to produce any. I am cautiously optimistic about another two trips we have planned but crossing from Canada has been a breeze so far. This next trip will be a land crossing we're keeping our fingers crossed, hoping it goes as smoothly as the airport POE crossings.

I crossed by land last time and will again this time. they didn't ask me anything different than the other times I had visited prior to filing. should be nice and smooth for her! :D

I am considering a surprise visit and I am extremely nervous about trying to cross the border, and reading this threat made me even more nervous. Here's my situation:

In February, my fiancé (then boyfriend) came to Canada and then we were intending to drive back to the US together. I intended to stay for about 2.5 months. I had a return flight and a letter from my employer saying I was approved for a leave of absence, as well as travel insurance. They did not let me cross. I've yet to read about a situation like this so I'm curious and nervous. When they didn't let me cross, they didn't even ask to see any of my proof of ties to Canada even when I offered them they said no (This is all pre-K-1 filing). They allowed me to retract my 'application for entry' because they believed my intentions were honest. We were stuck at the border for hours where I had to swear under oath all of my intentions (to visit my boyfriend, that we intended on applying for a K-1 eventually, etc). They took my prints, picture, etc. Gave me a copy of the paperwork and he was on his way to drive me home...... Worst day of my life.

Since then, I haven't tried to cross the border at all. He has visited once since with no hassle, and then we sent in our application for the K-1 Visa. We've only so far received a receipt that it was received and the cheque was cashed.

I really would like to still use my flight that I already had booked from the US to Canada on April 16th and I was thinking that I would like to surprise my fiancé with a week visit. BUT... I am soooo nervous they will not let me in. I know I could be banned from entering for five or ten years if so. Here's my situation:

I live with my mother, and pay rent to her monthly, but my name isn't on her lease.
I haven't gone back to work since the leave of absence started. I still have the letter saying I am expected back to work on April 19th.

I have travel insurance through my bank until April 19th.

I can produce bank statements showing I have savings, however no money coming in since February.

I have the paperwork from when I was denied entry, showing I swore under oath that we would be filing for a K-1 and that I intended to marry him.

I have a copy of the K-1 Visa paperwork we sent in this month.

I can also have a copy of the e-mail sent to him saying that the Visa was received by them.

I just am so scared that they won't let me cross due to lack of proof of ties and I will be banned from re-entering for five-ten years because if that were to happen, we would change our plans completely and he would have to move to Canada, which we both don't want. Has anyone had any sort of similar situation who can offer me advice? I'm so nervous!! Thank you.

Are there some POEs that are worse than others when it comes to visiting your significant other? I went through Detroit in January, when asked said I was visiting my boyfriend, and was let through no more questions asked. I'm traveling again in August (for 88 days), but through Minneapolis St Paul this time. We haven't started the K1 process yet. I've read through many of the POE reviews, but these all seem to pertain to entering on your K1, not before. I'll be bringing a letter from my employer stating I'm on an approved leave of absence, from my university stating I need to be back to defend my master's thesis, and from my landlord confirming my ongoing apartment lease. I'm thinking maybe since I already told them last time I was visiting my boyfriend, I should just say that right away this time, instead of saying "friends" - I don't know if they have it noted anywhere what I've said before...

Anyone with any experience from Minneapolis St Paul?

I know a lot of people ask about this and to be honest I wasn't sure myself. Yesterday, Sunday, after another weekend missing my fiance, I emailed my immigration lawyer to ask what the deal was with visiting after application. If there was any possibility I could visit for a week or two. Within 2 minutes he emailed me back saying point blank, "Scrap the idea, you will be denied entry"

I'm not saying others havn't been lucky enough to experience something different but this is mine and thought I should share.

Lawyers have no idea and i still have no idea why people use them for a k1 process.

Almost all lawyers will tell you this. They are covering themselves. They are wrong. A lot of us travel successfully whilst going through the K1 process. You can be denied entry but the vast majority enter the US successfully.

Personally,

I was, and still am terrified of the process. I felt having an extra, more experienced person dotting 'is' and crossing 'ts' couldn't be a bad thing
