My girlfriend is from taiwan. She flew to the u.s. last week so we could meet for the first time. She landed at detroit metro airport and was denied entry when she said she was here to visit her boyfriend. She speaks poor english and was not offered a translator. She was very nervous and had difficulty understanding most of the questions being asked.

My question is now that we are out the round trip airfare, time and effort does she have to wait a specific time before trying to enter the u.s. again?

Intending immigrant on a travel visa was the reason for denial.

Well after some thinking and talking to the US embassy here in NZ who advised me that while waiting on the process of your I-29F you can travel to the States under the VWP I am going to make a trip to see my fiancé, this sitting here waiting is killing me

Somebody told me that we have to write the address in Texas.....

That s why I was confused .

Yep... Texas is right. Dallas is a city in Texas where the USCIS is located.

I NEED SOME HELP I RECEIVED "RFE" ON AUGUST 23, 2013 AND WAS ASKED TO DO A G-325A AND A LETTER FROM BOTH ME AND MY FIANCEE THAT WE INTEND TO MARRY WITHIN 90 DAYS. I HAVE RETURNED ALL THAT IS ASKED AND AS OF SEPTEMBER 9, 2013 THEY HAVE RECEIVED MY DOCUMENTS AND NOW I AM AT THE "RFE: RESPONSE REVIEW" STAGE. HOW LONG DO YOU THINK IT WILL TAKE FOR THEM TO MAKE A DECISION?

This is a thread purely for people who are wondering whether it's still okay to visit the US whilst going through the K1 process.

You might have better chance of a response if you create a topic in the K1 sub-forum. Or I think there may be a topic for RFEs? Actually, it's the RFE Master Thread which is pinned just below this one. Did you post in this thread by mistake?

I just read through the entire thread, thanks for all the stories, it's really encouraging. Two questions though,

Has anyone had success visiting their spouse, vs fiancé? Is that going to make a big difference?

Are the any successful B1/B2 tourist visa stories during a pending immigration visa? My Husband is from a non VWP country.

As this thread is under the K1 area, most of the posts are going to be about fiance/ees visiting. However, spouses do visit successfully also. I would say that spouses possibly have more scrutiny because the tie between the two people is stronger legally but as long as you have strong ties to your own country, you should still be okay.

You can try for a B1/B2 visa for your husband. However, the chances of being granted that is going to be remote, to be honest. If you have already started the spousal visa process, he is already showing immigration intent. To get a visitor visa, you normally have to show non-immigration intent.

You can certainly try for a visitor visa. If the visitor visa is denied, it will not affect your spousal visa. However, ensure that you are 100% truthful with the application for the visitor visa. There was recently a K1 application reported on VJ where the person omitted to mention in their visitor visa application that they were visiting their fiance and the K1 visa was denied because of it!

My question is, can he send all the paperwork and start the whole process while me visiting him? As far as I get I don't need to be in my home coutry until the interview (saying I have all the medicals and other stuff prepared).

Yes, you can start the process whilst you're in the US.

I traveled to the US on July 18 2012 and we submitted our petition on July 20 2012. I returned to the UK on October 15 2012. It's actually a lot easier to compile all the paperwork and complete the forms whilst you are physically together. Just ensure that any paperwork you need for the petition, you take with you on your visit. You don't need to return to your country until your medical. I mailed all of my 'package 3' forms directly from the US (whilst on another trip, that is - it took us 9 months to get our NOA2).

I am would just like to add to this thread that I sucessfully visited my Fiance three times after he filed, once on my own entering via Newark and twice with my two children (included on the petition) entering via Houston, TX. Visits were 2 and 4 mths apart. I did not carry any evidence of ties with the UK (am not currently employed) and the last trip was in order to start my kids at school on time while waiting for our K-1 interview to be scheduled in London. I/we travelled on the VWP program and perhaps I/we simply don't have a profile that is typical in terms of any suspicious or adverse intent (I am in my 40's) but we encountered no issues at Immigration or additional questioning.

K1 visas were Approved in London earlier this week and we're now just waiting for the return of our passports.
