Actually I know that you can't have two visa application ongoing at the same time, because when we first started getting serious we were thinking about the K1 and apply also for the working one, but somewhere on the US website said that you cannot have two visa pending applications at the same time, so we opted for the K1. Also as a tourist visa holder I know the moment we get the approval for the K1 right there on the consul they will take my BCC, so my advice is don't try it because you will waste money they will at least charge you $160, that it's if you live in the city where the consul is, but if not you will have to pay for transportation and so on.

I would have my fiance visit me, or maybe meet him in another country as pre honeymoon trip :)

Hi everyone!

I just wanted to share my POE experience with you.

I landed into Chicago O'Hare yesterday afternoon. I was very nervous since this is my first time travelling to the USA since we filed for K1 visa.

I was really surprised at how smooth it all went.

This is what the woman at POE asked me and my answers:

"What is the purpose of your trip?" Leisure

"How long are you staying in the US?"1 month

"May I see your return flight?" I show her my e-ticket confirmation

"Do you have any family here?" No, but I have a fiance

"Where does he live?" Phoenix

"Are you going to travel to Phoenix on this trip?" Yes

"How long are you staying in Chicago?" 1 day, 1 night

"What do you do in Switzerland?" I answered

"What does he do in Phoenix?" I answered

"When was the last time you were in the US?" December 2012 "How long did you stay" 2 weeks

"When did you meet your fiance?" The last time I was in the US "Oh, you got engaged fast" Well, he spent 3 months with me in Switzerland this year and proposed before going back home"

"Are you planning on getting married during your stay?"No, we've applied for K1 visa and will marry once I have it

Then she took my fingerprints and photo, wrote something on my customs form, handed it to me with my passport and said "You can go, have a nice stay!"

I WAS SOOOO HAPPY!!!!! :)

The border official was really nice and I didn't need to show the copy of NOA1 or any of the documents I'd taken with me (certificate of employment, proof of address, bank statement).

I'm just a few hours away from flying to Phoenix and seeing my fiance. It's been too long! We haven't seen eachother for almost 4 months.

So excited!!!

Well I see that the situations vary greatly. Here´s my situation. I live in Spain now but I just got offered a great job in LA and I might take it (I´m a US citizen). So we would have to apply for the I-130 ASAP.

However I would have to leave for my job certainlyl before we got it. Big problem? My husband doesn´t speak that much english. Will that be a problem when he wants to come visit me? If they start asking him all these questions in English he wont be able to answer them very well I believe. The only proof he will probably be able to show is a ticket back, because most of the things in our apartment in Spain are under our landlords name and he has a part time job that ends in September.

How can we do this?

I assume that your husband is Spanish? If so, then he will have no problem with finding someone who is a CBP who speaks Spanish. There are so many Hispanic people coming in and out of the US that they need a lot of people who speak Spanish. In fact, so many businesses over here will have on their adverts 'we speak Spanish' - well, rather, it's in Spanish!

Spain is part of the VWP, so your husband will not need a visa. However.... he will have to show as many ties as possible to the Spain. As you will already have started the I-130 process already, he will be showing intention to emigrate to the US. He needs to show that he needs to go back to Spain. Does he have a car?

Yes, sorry! I didn´t mention it. He is Spanish, and speaks Spanish. He´s been working on his English but I doubt it´s a level to answer all those questions. The car we have is under my name. He works on an off, and his contract is up Sept. 15th.

He could just come with me for the initial move, while we look for an apartment, buy a car etc, stay those 3 months and then wait for his Inmigrant Visa. But I see it could take a while. Is it really 8 months?

What else could be proof to tie him to Spain? Enrolment in a degree?

ETA; Also, I dont think i can start the process until I start working because I dont have a US account. So I can´t make a check from an American checking account. It doesn´t make a lot of sense that it must be 100% from an american bank, particularly if you´re filing from outisde the US.

The other post you started has some responses that you might want to take a look at. Yes, it's really 8 months.

If he goes with you when you go back and you say you're looking for an apartment together, buy a car etc. and he's planning to stay the whole 90 days and he has no job at home in Spain, they're not gonna let him in, imho. It'll look an awful lot like he's planning to stay put with you.

Good proofs for home: School/College, a job, a house rental agreement/mortgage.

Hi! I have a particular case...

I am from Argentina but my grandfather was Spanish, which is why I got the Spanish nationality from him.

I applied for the K-1 Visa with my Argentinian passport, which is the one I always use to leave my country, but I ALWAYS enter the States with my Spanish passport (VWP). When we applied, I sent copies of both my passports, and I am currently waiting on our paperworl to get to NVC.

My question is... does anybody know if the K-1 Visa shows on both my passports or only in the Argentinian, since that is the one I used to apply for the K-1?

Hey everybody :) I've got a question, since I scheduled my interview date and it is going to be in a month....and I am already getting nervous, ehh... do you think that traveling to the US during your fiancee visa being in process can somehow affect the result of the interview? I mean affect in a bad way. I am still in America and literally when I get back to Poland, I am having an interview 2 days after my arrival.

It shouldn't be an issue.

I sent all my paperwork to the London Embassy whilst in the US and flew back to London on the same day as I had my medical (landed 9am and medical at 3:10pm - not recommended - my blood pressure was raised because of it).

Hi all

Below is my latest experience at the POE. I don't have a K-1 pending, and am getting married this visit to pursue the CR-1, but felt this would still be helpful as I made the border officer aware I was in a romantic relationship with a USC.

Officer: What's the purpose of your visit?

Me: I'm visiting my boyfriend.

Officer: How long you staying?

Me: 2 weeks and 2 days.

Officer: Have a nice stay.

ROC from CR-1 visa (Green Card expiration date was Nov 24th 2016)

 

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.
