Hey everyone. Let me start by introducing myself. My name is Renato. My fiancé, Ana, is from Brazil. She has been here twice already this year. The most recent, we went together on vacation to Portugal and came back intro the US together. Unfortunately, the CBP officer escorted her for a a secondary interview, possibly because I stated that she was my girlfriend. Although they let her into the country, I'm a little worried that they may not let her in next time. I am currently in the process of filing for a K1 visa. I will be mailing my application on Monday actually. I would like for her to come for her vacation once her semester is over. She is currently enrolled full time in school, but does not have a job, own a house, or a car. It seems to me that her only form of proof that she has to go back home would be that she is a full-time student. If she were to come her at the end of June, it would be a little less than two months since her last visit. Unfortunately, she won't be able to come until December is she doesn't come now and I'll be starting a new job Monday so I can't fly down for quite some time. I'd like to get your opinions on whether it would be a good or bad idea to have her come. Also, if they were to deny her entry into the USA, would this negatively impact our K1 process? Thank you all for you help.

Hi Renato.

You say that she has visited twice this year but have not mentioned for how long. The rule of thumb is that she should spend more time out of the US than in it (although I have spent more time in the US than out of it during the past year).

Whether it is a good idea for her to come or not is not something I can advise on. If you can afford the airfare with the knowledge that she might be denied entry, then it is certainly worth trying. That is the way I have approached it. I fly with hope but prepared for disappointment.

If she is denied entry, then it will not affect your K1 petition. It just means that the next time she will be able to enter the US is when she actually has the K1 visa in her passport.

And here is a checklist of things to show her ties to Brazil:

You say she doesn't own a house but does she rent or live with her parents?

OK. So she's spent more time out of the US than in it, which is good.

My fiance thought I was mad but before I left the UK last time for the US, I took photos of the room I rent to show how much of my stuff was still in the room. I ensured that the time/date stamp was working so they knew that I hadn't taken the photos before packing. I actually included my suitcase open on my bed so you could see it full of clothes. I just wanted to do all I could possibly do to prove to CBP that I had to come back.

The last time was the first time that I had to prove I had a return ticket. I have made 5 trips to the US in the last year - the shortest one was 6 days and the longest 90 days (the maximum allowed under the VWP that UK is a member of).

Hi Everyone, i love reading all of the successful stories of people making it into the states to visit their loves! i'm not sure if my question sits on this page or in the Diversity Visa page because it crosses over both... My situation is that we have applied for a K1 visa and have so far received our NOA1 but i was also successful in the 2014 diversity visa lottery and have also put my paperwork in for that....I know nobody can say for sure if i will be let in or not, but i'm going to visit in July for 1 month on the VWP and am wondering if there's anything i need to be prepared for other then proof of my ties back to Australia (which i have plenty)...My tickets were already booked before i found out i had been successful with the Diversity Visa i really hope i'm not turned away :(

Hello everyone! :) I am totally new on this forum, but I am so happy to read about your successful entries to the US, while your K-1 is in process!

We sent our K-1 application in February 2013, already got our first NOA. And we decided that I am going to visit my fiance for the summer, and actually I am leaving on 22 of June... I am kinda nervous. It will be a long flight, like always, and actually 2 flights (Poland-Amsterdam-Seattle). I already visited the US twice in my life, but not for so long, using my travel visa, and we haven't been engaged yet. The last time I visited was in December 18, 2012 and I came back on January 13, 2013, and I've never had any problems at the POE.

I seriously have everything that I could only think about, I mean proof of the ties to my country, like the itinerary (which also says the date of my return), the whole copy of 1-129F, bank statement and records, travel insurance, proof of being an employee at my previous company I worked for (it was a temporary job, so that's why I was able to get money to visit my fiance), statement from my new employer, that I will start work as soon as I get back from my vacation in the US, school statement (with the date of the beginning of my last semester), and even a proof of ownership of the apartment... This is the very first time I am so scared. I have no idea what to expect at the POE, what questions... Of course I don't want to stay there, until my visa is granted, I am aware of the consequences and that would be so stupid if I risked already all the things we put into this visa, our time, money, nerves... and I understand I could even end up being banned from entering the US for the rest of my life. So I really DO hope that the person I am going to talk to in Seattle understands that we're doing everything legally and I am not moving until getting an approved visa. I'll keep my fingers crossed, and wish me luck.. :(

I wish I could hear from anyone, that was also visiting during his/her K-1 was being processed, and his/her POE was in Seattle

Ehhh, why is it always so scary and complicated, when all you want to do is just see the person you love...:(

Lots of love and patience to everyone!

The amount of documentation you have is great. That will really help. Are you going to include a copy of your NOA1? Your whole I-129F package is good but the NOA1 is proof that you sent it off!

You can see my experiences of POE at Chicago O'Hare earlier in this thread (I have travelled 5 times in 15 months). As you've asked for specific expereince regarding Seattle, I've asked another member of this forum who I know has a POE of Seattle if she could possibly contribute to this thread to help you.

Hello! My fiance is from Seattle. I visited him 3 times , the one time was before our NOA2 in February. Now, my experience was weird, my other VJ friend on the other hand said everything was ok for her in POE Seattle, no questions no anything. I will try and find my experience. Make sure you have your NOA1 with you, strong ties like letter from boss and landlond and be very friendly and truthfully.

Well!!! I am in Seattle.. let me share my experience then.

Passport (customs) control : Super friendly

The lady ask me immidiately

-who am I visiting. I said my fiance and my friends.

-What do I do for a living.

what does my fiance do for a living

-If I carry foods. I said died fruits lol

-When I am getting married. I said when the k1 visa is approved. She smiled like she was saying good answer and thats it.

Now the stupid part. I was "randomly" selected for the customs control (to search my suitcase)

The man there was so tricky.. He asked me :

-why do I have greek passport and why do I live in Germany

-What do I do for a living and to explain him what that is.

-What does my fiance do for a living and explain what that was

-how did we met (I said facebook and he laughed)

-searched my bags while asking a thousand questions like : when did I visit last time, when did visit last time, how many days I will stay and THEN He saw my documents like letter from landlord, letter from boss and petsitter and he was like look... I searched your bags and it seems that you are for vacation here but seeing that documents its like saying I trying to hard.. Im like ok.. really?.. how else am I going to proove my ties? sad.gif He said : why did you bring a birth certificate (it was a residence certificate) I was like its a residence certificate to proove that I live in Germany! It has my birth place as my passport (smiling)

Then the last thing that was weird was like, why dont you guys get married now and file for AOS? I was like really... thats illigal and we are getting a k1 visa.. everything sir will be done be the law. If I file for AOS I am illigal.. and thats not nice.He was like ok ok.

He was friendly and kinda flirty too or rather too friendly idk I was so upset.

He then said to me have a nice trip and next time you will come here only with your visa

Thats the last time im flying seriously that was SO bad.

That was my experience. Then again all weird things happen to me lol

First of all, congratulation on getting your approval of your visa!!!

Thank you so much for your answer! Yes, I have a copy of my NOA1 with me (my fiance did a copy for me and sent it to me) and I will take it with me. Wow, 5 times during K-1 process? That's awesome!! I am going to read about your experience right now! :) My fiance and I decided, that this is going to be the only one time of me visiting on my tourist visa, before my fiancee visa is approved. We're expecting to get our NOA2 in July/August, so it's not that bad anymore hehe :)

Thank you again for your help!!

It's just amazing that we all can share our experience here and support each other :)

Wow!!! I am truly amazed that you were able to visit your love 3 times! You're so lucky!! I am only going to visit once before getting my fiancee visa, since we're expecting to get our NOA2 in July/August.

Hehe, I just think they don't really have that many K-1 visitors in Seattle (rain, you know...:D:D) so maybe that's why they're not that suspicious. But that really depends, the last time I visited (still using my tourist visa) nobody asked me about anything, except for what was the last name of people I was going to visit. And I remember my first time visiting was really stressful, at the very end, after all that questions I was even expecting a question about my underwear color.

Yeah, that suitcase control is a new thing I think, because nobody checked my suitcase the very first time I visited.

I also think they only are going to ask so many questions if I tell them I am visiting my fiance and his family, but of course I am not going to lie, if they ask who I am going to visit, I will answer honestly. If they only ask about the purpose of visiting I will tell them summer vacation, which I think is not a bad answer, isn't it?

How long did you usually stay there, Arinlars? Because I've got tickets for the whole summer, till August 24th... but I am starting my last semester in September and also my new job, so I really do hope it's fine. Do you think visiting during our K-1 could affect the results of my fiancee visa...?

Thank you so much for sharing your experience and your help! My lovely neighbor :D (Poland-Germany :D)

Hugs!

I just got back from a visit to my fiance. I went through US border control at Vancouver Airport. I had copies of our NOA1, NOA2, i129 form, my current contract showing that I was contracted to work until October 2013, a copy of my mortgage statement, my travel insurance documentation covering only the period of my visit and of course a copy of my eTicket showing my return date.

The border control guard asked me the purpose of my visit, I said I was visiting my fiance for 2 weeks, and offered to get out my return ticket to show her. She said "no, that's fine, just put your hand on the fingerprinter" and told me to have a good trip (which I did!).

(NB: suitcase photography is done at Vancouver - I only had a small bag in the hold, and a laptop bag and purse as carry on luggage)

I was actually a bit disappointed - I'd brought all this documentation and they didn't want to see it!

Ha ha. It does get you like that. You think 'But I've done all this preparation for coming through here. Don't you want to see my work?'

Congratulations for getting through okay. I hope you had a great time with your fiance.

2013-04-22: Called USCIS and corrected the typographical error on the NOA1.

Hey! I am going to stay in the US for 64 days... So I really do know how you feel, that's the very first time I am that nervous :) But everything just HAS to be allright, there's no other way. All you have to do is just to convince them you will come back. Same with me, I just hope not to get so many questions....and it's really hard not to carry that many things, when I am going to stay there for that long. I'll keep my fingers crossed for both of us. :):):)
