she has lots of luggage because she is moving from China to Canada permanently.

her stay in April was for 10 days and had to go through secondary and well wasn't prepped for that and was a shock for her.

She is arriving late Thurs and leaving the following Tues. have onward ticket.

She would have phone number of a contact (relative friend) in Canada where they can verify where she will stay in the short term. They can call her ex (still located in China) to confirm why she is moving there as well.

She was asked why she was coming again so often she basically stated she's here visiting friends - not a lie but exact truth. She offered to show friend pictures and they weren't that interested (during last time's secondary).

After this POE, I'll be visiting her than have her come to the US. We might try to enter the US together July 4th wknd -Niagara Falls via car. Just for a night or so. Will this be an issue?

.

Building her case will depend on how many ties to Canada she can accumulate before attempting to come to the US. See here for things to build her case - http://www.visajourn...content/k1visit - other things like phone contracts, car, insurance will also help. I know you haven't started the K1 process yet but this is still relevant.

Why will she 'obviously will have a couple of large suitcases'? How long is she intending to come to the US for? Is the amount of luggage appropriate for her length of stay? You said that she had a POE of April. How long was that stay and how much time will she have left between that stay and this next one?

If she gets asked about your relationship, she will have to disclose it. Never, even lie to a CBP officer.

OK. She may have a problem coming to the US before going to Canada. Not definitely but maybe. The shortness of her visit and the onward ticket may help. But at POE in the US, they may think that she wants to settle in the US with so much luggage. Will she have evidence of her PR status in Canada on her?

She needs to be careful about the difference of 'friends' and 'a boyfriend'. If she says 'friends' and then they phone her ex or her Canadian friend, they may say 'yes, she's visiting her boyfriend . I know you say it's not a lie but it is hiding the truth. There is a lot of difference between visiting 'friends' and visiting a 'boyfriend' and CBP know this.

On 4th July, can't you drive to her? I know it's a US holiday but... Do you want to risk her getting a denial and that might be it for her visiting the US until you get the K1 visa, if you decide to go that route?

I'm sorry - I can't tell you for certain. I have always disclosed it at CBP if I am asked who I am visiting - i.e. it usually starts 'Who are you visiting?' 'My fiance' and it goes from there. My feeling is that they can't tell but I do not know that for sure.

Even if they do see that you're in the middle of the K1 process, it doesn't really do any harm. It's a balancing act for them. You have already indicated that you want to enter the US permanently by starting the K1 process but you are also showing that you are doing it the right way.

Thank you!:)

I will be entering US with my parents and they are actually going on vacation there )

So I don't know - maybe it would be better for me to say that we are there just for vacation purposes...

Of course unless CBP officer doesn't ask about whom I'm visiting))

She told them about her plans to move to Canada last time she went through secondary. They asked why she was coming alone etc. She will have her perm resident card with her. None of them knows about her having a BF. Her Ex doesn't know about the stopover in the US. I don't think she has an obligation to tell him about the stopover...Her contact in canada doesn't know the reason why she is going there, just helping her find a place as he is just a relative friend. There's no issue in getting her ex to confirm the story that she's moving to Canada on a permanent basis, he will bring the kid over in a month... her friends here will also back up the story cuz she will visit them. Not the 100% truth but...

I understand completely. I get very sensitive going through customs - I start to perspire and my heart pounds.

I just ensure that I have all the paperwork with me that demonstrates that I have to return to the UK. This is a really good page to start with:

http://www.visajourn...content/k1visit

Thank you very much! My boss really likes me and owes me quite a lot so I know she would gladly sign me a letter of employment if it is to help me out =)

May I ask you how much was the longest time you visited the US?

The longest I have stayed in the US is the full 90 days allowed under the VWP - 1 December 2012 until 28 February 2013.

It's not a problem. If you need to disclose your situation at POE, it will show that you are so far along the route of getting the K1 visa, that it would be foolish of you now to overstay. Just remember to bring al evidence of current ties to your home country.

Hello everyone! I just want to feel out some opinions for visiting.

We received our NOA2 on May 16th (earlier than we expected as CSC was dead when we first applied). We already have a vacation (with my family) booked for August 6th through the 18th here. We're going to Disney World with my family for the vacation. We are planning on requesting an interview date for the 19th of August or after, obviously.

Anyway, does anyone have experience with this through Orlando? He quit his job to prepare for the move, owns a house (so no mortgage), but will have all of his bank statements. Additionally, I'll send him all the stuff for the interview so he'll have the NOA1 and NOA2, as well as letters from the embassy and potentially an interview date by that time. Even more, he'll have copies of our vacation info (6th through the 16th at Disney and 17th at a hotel near Universal) and a return ticket.

Any advice or just simple reassurance? I'm much more stressed about it than he is, to be honest.

I am the USC/petitioner.

12/26/2012 - NOA1 received via text/email
12/27/2012 - Checked cashed by USCIS
12/31/2012 - Alien Number changed (NOA1 hardcopy in post, but was away for 2 weeks prior)

05/16/2013 - NOA2 received via text/email

05/20/2013 - NOA2 hardcopy received in post

He has to prove he has an intention to leave, of course. One would logically think that if he already received his NOA2, he would go back for the interview, but to be on the safe side, I would have him bring anything you can think of to prove he intends to go back. The fact that he already quit his job is not really good, but it's always possible he'll just be waved through anyway.

If this vacation is in August, why not interview before then? It might be possible.

What would Xenu do?

He's a filmmaker so "quitting a job" was more of a "phasing out of a company to work on his own" sort of thing.

For London, it'd be a close call to get an interview before then. Also, once he has the visa he can't come and go and he has things he needs to do in the last couple of weeks of August. For example, he'll be renting out his house, but he doesn't want to solidify that until he has a visa. Even if we could interview the last week of July, it doesn't give him time to sort that before he'd come over for vacation and not be allowed to go home for several months.

Ah, I see. Perhaps the necessity to rent the house could be shown as evidence somehow. He could show that he will need to be in the U.K. to actually rent out the house, and therefore does not (yet) have immigrant intent.

It's so cool that you guys are in the film industry. I used to be in the entertainment industry myself, but those days are behind me.

I'm hoping that there just isn't really a problem. I mean, he'll have proof that he's going to Disney World for the time stated and a return ticket, which going through Orlando must be EXTREMELY routine. I'd be surprised if he was questioned beyond "What's the purpose of your trip? Going to Disney World".

We love the industry. We don't really know what else we'd do, tbh.

I just proposed to my fiancee in May month and she's coming to visit in June. She's going to bring her most recent paystubs, a statement from her college showing her college and semester, and a recent credit card bill with her home address (she lives with her parents again and doesn't have any lease agreement). Do you think this is sufficient to cross into the states? She's coming from Canada.
