Yeah, I think I will try at the end of April. I think a 76 day stopgap, a healthy bank balance, and like you said, a return ticket (easily changeable) will be ok. I'll be taking everything I can to prove i'm coming home. Work agreements, phone contracts, doctors appointments....the list is endless.

Have you been in touch with anyone about your long wait? congressman etc?

We have a lawyer (who we contracted before discovering VJ) who keeps nudging them. We haven't contacted my fiance's representative - most of them don't make a difference. We just have to wait....

Thoughts please since I see this discussion. I know it's up to port whether my fiancé gets thru. He was here for 6 months left march 16, right before his visa expired. K1 filed and he wants to return for my daughters graduation in may and plans to stay till June when we both fly back to his country. He then wants to fly back with me to spend the rest of summer as I am on vacation as I am a teacher. I would stay there in Australia but I would miss my kids too much. Thoughts???? Is it possible??? He has ties to Australia that can be proved and bank funds.

It is possible but will depend on the officers at POE and your fiance's ties to Australia. What were his stays prior to the 6 months?

:time: It helps when answering questions - for instance, when did you get your NOA1?

We just mailed the packet march 22. So we have a ways. Our first meet face to face was June 18 2012. He stayed 2 weeks. Thank you for your response!

My fiancee made it. But she was taken to the interview room for over an hour. Turns out though, it was because the computer didn't show she had renewed her ESTA when she went to the counter. So they took her aside to verify it, and while they were at it asked her questions about her student visa, and her fiancee visa, length of stay, etc. The only document she ended up showing was the NOA-1, and they never asked to inspect her bags. They were friendly and never made her nervous, just kind of bored and tired. All told, she ended up exiting customs 3 hours after the plane landed.

Just get him to bring as much documentary proof as possible to show that he has to return to Australia plus copies of bank statements. I asked about the date of the NOA1 because the nearer to the NOA2 you are, the more you would have to lose by overstaying - or I would hope that the immigration officer would see it that way at POE. That is part of what I'm hoping in 9 days time - would I really risk all we have worked to when we are 8 months in the process by overstaying now?

I'm really pleased she got in but I bet you were worried after waiting 3 hours! Did she have a paper copy of her ESTA with her? The ESTA system says you don't have to but I was carry a copy, just in case. Although, in her situation, they would still need to look it up to confirm it.

As simple as this: YOU CAN VISIT!!!

I was so scared when I got over there but It was easier than ever!

I visited a couple times before starting with the visa process and I felt this time was the easier!!!

My advice to everybody from Spain or somewhere from europe is try to avoid NY or Philly airports...I went form Barcelona to London and from London straight to Orlando (wich was my last destination).

I did that because I didn't want to miss my connection flight if they start asking too much...

Another advice: don't give free information to the officeer... My earlier visits to the US I was explaining my whole love history to the officer and my now fiancee was like: why do you do that??? So just answer Yes or No...and if they what's the porpuse of your visit, just say Hollidays or vacation...

Actually my officer (a hispanic lady) answer the question for me cause she was like: do you come to visit some friends?? And I was like: yes!!! (thinking to myself that she made it so easy for me) LOL.

So don't be affraid...bring with you if you feel better a letter from your job (if you are working) that says that you need to be back...and that's it. Maybe it was luck but i didn't have no problem.

For whoever wants to know it...i went there while we were waiting for or NOA2 (still waiting now) and they can't see nothing in their computer screen about visa...so don't worry

Also i have a friend of mine that visited when she had already her NOA2 and she didn't have any problem either.

Actually Im planning on visiting again hopefully when we get our NOA2... so...

Idk, just keep in mind that there's NOWHERE where it says that we are not allowed to visit, and stay calm!!!

Good luck to everybody!!!!

I posted in here a week or so ago, when I was thinking about visiting my fiance in Texas. We have now booked the flights, so I though I'd pop back in here to check if what I have for ties is enough.

I'll be going for a 16 day visit under VWP, to Houston, but my POE will be Hartsfield–Jackson Atlanta as I'm getting a connecting flight from there. (Anyone have any experience entering there?)

I'm rather nervous as it will be my first time flying such a long distance alone. I've only ever gone around Europe on my own, which I'm sure must be quite different.

I don't have a job in the UK and I'm living with my parents.

So this is what I'm thinking of taking for my ties to return:

Return Flight

Travel Insurance matching flight dates

Certificate of Car Insurance

Phone Contract

Copy of NOA1

I know nobody can tell for certain, but does that sound enough or am I likely to have problems?

You're right that no one can tell you for certain. However, as this is your first visit to the US, you are unlikely to have problems.

I would also consider taking copies of bank statements showing that you have sufficient funds to cover your 16 days. They aren't interested in available funds on credit cards. Remember to print out a copy of your ESTA. The website says you don't need it but someone here had a problem when the US system didn't show up her ESTA and they took her off to look it up.

Is you car owned outright or is there a finance agreement on it? I don't own a car in the UK so don't know the process but can you copy something that shows you own it?

I just rent a room in a flat, so have a similar problem to you. I took photos of my room just before I left for the airport, so they could see how much stuff was left. They were timestamped. My fiance did point out to me that it could have been any room, not mine and I just moved my cases in there to look like my room. But it made me feel better at the time,

It's actually my second visit, I went on a 2 week family holiday to Florida back in 2007. I'm assuming as it was 6 years ago now and was only for 2 weeks, it will have no effect on this visit.

I was thinking about just taking cash dollars rather than using a bank, as I'm sure mine charges stupid amounts for withdrawals abroad. Would this be just as good?

And I own the car. I have the Registration Documents to prove this, should I throw in a copy of that too?

Taking cash dollars are fine but check your travel insurance to see how much you are covered for loss of actual cash. I would still suggest you take copies of bank statements to show that you can support yourself independently for 16 days. Unless, of course, your bank statements don't back that up! I know what it's like. Obviously, I stay in our apartment in the US whilst I'm there so there is not the expenditure of a hotel. My fiance pays for everything whilst I'm there and it's a struggle sometimes to get him to allow me to pay for anything. Once our funds are combined, then it will be easier.

Yes to a copy of your registration documents. In fact, out of all the things you've stated, that is the thing which shows that you have a tie to the UK still.

Yes it does matter. Never, ever lie. Only answer the questions they actually ask but never lie. If she says friend and they then find that you're in the middle of the K1 process, they will know she is coming to meet you.

If she tells the truth, the worse that can happen is that she gets denied entry to the US but that does not affect your K1 petition.

If she lies, the worse that can happen is that she gets banned from entering the US and that could affect your K1 petition.

What kind of figures are they likely to be looking for, for a 16 day stay?

As you mentioned I will be staying in his apartment so won't have any hotel costs either, and I think I will have a tough time getting my fiance let me pay for anything too. Will they take into account that I won't need a hotel or would I need to cover that too?

Also, my bank is very against paper statements, I'm only allowed two paper copies per year unless I pay extra and I've used those two up for the K1 package. Would I be okay to just screenshot my online page (making sure it has my details in view)?

(Sorry for all the questions, I just want to make sure I've covered everything.)

See this item on the US government website:

https://help.cbp.gov/app/answers/detail/a_id/796/~/foreign-visitor-having-to-carry-a-certain-amount-of-money-to-enter-the-u.s.

With my bank account, I can go into the branch and get an official statement from the machine - I bank with Barclays. If you bank online, you can usually get a statement online - often as a PDF. Check to see if you can do that. If not, then a screenshot will suffice. Ensure you have you login details with you just in case they ask you to login to prove sufficient funds.

This is probably all overkill I know.
