I'm from Australia. VSC is so slow so i decided to go for a visit. I arrived in 24 July, I had all paper work to show ties back home... Letter from work, copy of noa1, last phone bill, etc. I was asked why I was here? I said to visit my finance, how long an I here for? 7 weeks. When was i last here in the US? I was here in feb/ march.

Enjoy ur time with ur girl... That was it... No proof of return flight or ties to home. Great experience at LAX. Everyone...go for it if u can get the time off and afford it. Just what we needed :) especially at VSC is so far behind. Having a great time with my bride to be :).

Wow, that does sound nerve racking. Do you think it was because there was only a 5 week gap between your visits, or because you had filed for the visa?

It was definitely because of the short gap between trips, if it had been a longer period of time that I had stayed back in Australia I don't think it would have been that bad. I can totally understand from their point of view why it looked so suspicious. But I answered honestly and didn't lie about anything.

I think advising them that we had submitted the I-129F and were actually trying to do things the right way was why she let me in. Plus my first visit I left on time and didn't overstay.

Hey guys, I need your help and advice here.

Me and my fiance filed for K-1 Visa a few months ago and have already received NOA 1.

I visited the States in December of 2011 and left early February 2012(stayed for 2 months). In that period, he proposed and shortly after, we began to searching for immigration lawyers and such.

It's been almost 6 months since my last visit there and I was thinking about going again in late September and for only three weeks.

The problem is that the attorneys said that it wouldn't be a good idea since they can only give me 40-60% chances of getting in even if I have a character letter from them saying that I am their client and we've been doing things legally, have my return ticket, lawyer's card so they can call him if they want and proofs of the NOA1.

Since my fiance heard that, got really scared and didn't want to risk spending almost $1000 on a ticket to fly me there if I had only 40-60% chances of getting in.

I am desperately trying to convince him that my chances were much much smaller last time I visited him for two months.

Think about this: I was visiting a boyfriend, for two months, I had no job and no ties back home. No matter how hard I try to convince him that in my previous trip I was way closer in being sent back, he is just saying that the attorneys know better.

Iam replying back that the attorneys know the laws and speak with chances, thing I don't believe in.

I, on the other hand, believe that visiting now with the proofs of doing things legally and most importanly having a reason to not overstay, gives me more hope than last time.

So I'm asking, in your honest opinion, am I wrong believing that last time I had less chances than I have now and that there shouldn't be a reason not to try visiting now?

Thank you all in advance!

PS: I should also say that I've visited the States twice so far: once in June of 2011 for 3 weeks and once in December of 2011 for two months. Never overstayed.

Hi..You shld not have any Problem going to the US as long as you show proof of a return ticket. I have been here in America for 2mths . I came after i received my NOA2 and the custom is not aware of my K-Visa..they only ask general Qn like Why are u here? how long will u be here? Who r u staying with? ..as long as u answer truthfully the Qn , I don't see why they shld deny yr entry..

Filed: K-1 Visa Country: New Zealand
Timeline

Hello Everybody,

I am Alex and I am currently living in New Zealand for the last couple of years on a valid work permit. I am originally from India. I would like to seek some advice/opinion on my situation.

I met my girl friend online last year. She is from the USA. Things become more serious over a period of time and we both fell in love and decided to take it to the next step. Since, I am in possession of a B1/B2 visa which is valid upto August 2018, just last month I left Auckland, New Zealand to Los Angeles, Charlotte, North Carolina and eventually to Virginia. I proposed to her and got engaged :) . Well at Los Angeles I only was asked 3 questions:

a) Why are you here? For a holiday

b) How long do you intend to stay here? For 10 days

c) Where are you going? To Virginia.

So, I did not even get a chance to tell the officer that I was there to visit my girl friend.

Now we have applied for my K-1 visa and in the visa application I have mentioned that my embassy interview can take place in Auckland since I am living here right now in New Zealand. But the thing is my work visa is going to expire next year March 14th, 2013 which is 6.5 months away from now. I have been mulling the following options:

1) If in case my Auckland embassy interview does not happen by 14th March, 2013, can I leave for USA on by B1/B2 visa and stay with my fiance till the interview happens?

2) Or do I have to re-schedule my embassy interview to India, since that is where I originally come from.

3) Now in a scenario where I can leave for the USA after the expiry of my work visa in New Zealand, can I actually come back to New Zealand just to attend the embassy interview?

I know we have just filed the K-1 visa application but I guess there is no harm in preparing for all future scenario's.

I would really appreciate any opinions and advice.

Also, our case has been referred to Vermont, anybody with any experience in dealing with Vermont?

Cheers.

Hi everyone!

Here is my experience of 1 hour ago...:

I didnt have the "chance " to choose immigration offiicier. But didnt matter..

Him : Why are you here?

Me: for vacations

Him : do you know someone there?

: yes, my boyfriend.

So he took my passport and saw ive been visiting him 4 within 2 years then :

: how long did you stay in february?

: 2 weeks i think

: and in december ?

: same around 2 weeks

: so why are you staying 4 weeks now?

: well i have prepared a vocational training and i just passed my exam and my contract just ended up. So why not staying 4 weeks.

He smiled and said : what are you going to do when you go back to france?

: i may have an interview to work at airport in france so hope its going to work!

He took my finger prints, pic and stampes my passport!

Didnt need any proof of ties even if I brought some (electricity company certiicate translated, bank account, letter from brother..) but i do recommand to bring it though.

Hace a nice day everyone! :)

Does one have a better chance of a longer entry (5-6 months) before the NOA2? My gf is coming to visit from SA probably before the NOA2 and wants to stay up to the max time allowed and we are trying to figure out how best to accomplish this.

I was just reviewing the submitted I-129F packet and noticed there is nothing on the form that lists my fiance's passport number or other identification number. Therefore, how would the immigration officer know the K1 was filed (prior to NOA2) when she came to visit?

It has been 2 weeks since our NOA2 and I am headed the states (LAX) next Friday (7th). Have both originals of NOA1 and 2 with me, a return ticket, a letter off my employer (dated July though), and my work ID's. Hopefully I get someone nice at LAX and they let me through!

When i fly to visit Robin in Scotland I'll be flying into Manchester with our puppy because I'll be staying for 6 months what will I need to keep from getting denied ?

Please be careful...this woman was denied entry when she came with her cat for a 6 month stay on a tourist visa...there is also a follow up video of her talking about her ordeal...maybe worth taking a look?
