Hello everyone!

 

I've got my B1/B2 visa already since last year (granted for 10 years) and recently engaged to an American guy and now currently waiting for the NOA2 (received NOA1 on early of September 17') we expect we will get NOA2 possibly by this coming April/May 18' . So I'm planning to visit him by Feb 18' with my tourist visa, and as what I have read here, it's legal and fine to come visit as long as you have a proper visa/documentation. My question is, what are the possibilities you will not allowed to come visit? Lack of documentations? If so, will be I banned from visiting again? Will it affect my K1 process? I wanted to come visit but at the same time I don't want to risk my K1 application.

I am going this december for 3 weeks. I am a bit nervous because is the first time I go this long. I always go for one week. Also my boss was not excited about writing my employment letter and did not write that I am coming back January 11. Hope everything goes fine because I am an anxious person.

I think 3 weeks would still be viewed as a vacation and not as residing in the US. This would be granted you haven't spent any time in the US in the past month or two. If you have a job this is the strongest tie you can show. I am sure if the border really cares (which I doubt they will) they could always call your boss. I get heavily questioned at the border because I was denied entry before and they have never called anyone. You can always take your apartment lease or proof of home ownership. Maybe include a few other ties back home showing you have plans or other things to come back to. Another thing you have going is the fact you have come and gone to the US when you said you would. This builds credibility with the border. With it being Christmas I am sure border agents take the time of year into consideration. It's very rare to see anyone denied and from the sounds of it you have strong ties.

 Please let me know how it went for you at the port of entry, I am in the exact same situation as you, except I'm only visiting for one week. So nervous :wacko:

I have gone plenty of times, but I haven't been since we filed for the visa, so I'm nervous. I have a steady job and they will be writing me an employment letter, but I don't own a home, don't pay rent and don't have a car, so I hope my job is strong enough of a tie.

It’s really not as intense as it sounds. I visited multiple times and the guards at the POE only asked questions about how long I was going to stay. I never got asked to provide proof of having a house or job back home although I always carried that proof with me. 

 

The biggest lesson I learned from the entire process was: take the process seriously, but don’t freak out. The boarder guards are never as determined to give you a hard time as you think they are.

Thank you for sharing! That actualy does give me peace of mind, maybe it's just a tendency of us beneficiaries to overthink the whole process. On the other hand though, you are from Canada, a low risk country, and I'm from Mexico, which could be considered as a high risk country :S

That gives me peace too. And also Costa Rica for being a central America country could be considered as high risk country too. But who knows, the only think we can do is take the risk

Hi folks,

 

So based on the answers and people's experiences in this thread and elsewhere, it does seem like it's okay for a Canadian beneficiary to visit during the K1 process. We've basically made up our minds to try.  The only thing left to decide is how long of a visit I should make.

 

Here's my situation:

 

Due to all the current unexpected delays in processing, I no longer have a job or car or apartment. I have nowhere to host my fiance and he can't take much time off right now, so he can't come here.

 

I'll have a return ticket, a copy of my bank account statement, a copy of my credit card statement, my cell phone bill and a copy of our NOA1 and NOA2.  (We are still awaiting the hard copy of the NOA2 but we expect to have it by my tentative travel date in January.)

 

Our petition is recently approved, but, given the current 6 weeks delay at the NVC stage, plus another probably 6 week wait or more for the interview, we could be looking at another three months to POE. Possibly more, who knows.

 

Therefore, we would like to make this a six-week visit. So my question is...would that be pushing it?

 

I haven't been to the US since last March, when I made a six-week visit, returning on May 1st.  I've never been denied entry or had any problems at the border. 

 

My fiance has only been here twice in the intervening seven months, for a visit of one week each. Both times he was here, we thought the process would soon be over. Boy, were we wrong! :P

 

We just miss each other a lot.  And, now that our petition has been approved, we want to make tentative plans, go check out the courthouse and/or other alternatives since the delays have squashed the possibility of making concrete plans. We could also start gathering his documents and maybe I could bring some of them back with me, and so on. Just, you know, move things forward a little bit finally. I know everyone on the site here understands this. (L)

 

I know it's up to the border officer ultimately but does six weeks seem like it could be perceived as too long or problematic?

Hi everyone 

 

just putting my experience for anyone who's worried.

 

I'm at the stage of waiting for noa2 (day 100 today) and from Turkey (but traveling from Japan). I have a B1/B2 visa that I got around 6 years ago.

 

And this is my 3rd time this year, 

1)  before petition in May for 12 days - they asked me lots of questions at this time nothing out of ordinary though but it was my first travel to US in 5 years so I thought it was normal.

 2) right after the petition filed (we got noa1 when I was in US that week) they asked how long and for what- I told them to visit my fiancé who's in the hospital- nothing else.

 

3) (yesterday) Ive entered from LAX yesterday together my fiancé, we had two cats with us so we asked to line up together and I entered through the US citizens line. They asked if we were married and My fiancé said "soon", I said hopefully- the lady just said why hopefully- I said uscis is taking their time this year- and that's it, nothing else no tickets no how longs. 

 

all 3 times they gave me 6 months (and I can't believe I have to go back and can't stay for that long....)

Planning on visiting my fiancè in Massachusetts at the end of March for Easter & staying till end of May whilst we wait this process out.

 

How can i prove ties to back home if im leaving my current job before i fly at the end of March?

 

I have a friend who is a September filer, she has no job & flies to NY to be with her fiancé atleast 3 times a year & shes never been denied access on her ESTA but i just want more reassurance really.
